MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Stephen Barker and Casey Barker to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Quontic Bank, its successors and assigns, dated May 26, 2022 and recorded in Barnstable County Registry of Deeds in Book 35148, Page 1 (the “Mortgage”) of which mortgage U.S. Bank National Association, not in its individual capacity but solely as trustee on behalf of GCAT 2022-NQM4 Trust is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Quontic Bank, its successors and assigns to U.S. Bank National Association, not in its individual capacity but solely as trustee on behalf of GCAT 2022-NQM4 Trust dated February 21, 2025 and recorded at said Registry of Deeds in Book 36837, Page 215, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 84 White Birch Way, West Barnstable, MA 02668 will be sold at a Public Auction at 1:00 PM on October 21, 2025, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
A Certain parcel of land, together with the buildings thereon, situated at 84 White Burch Way, Barnstable (West), Barnstable County, Massachusetts 02668, as shown on the hereafter mentioned plan, described as follows:
Lot 3 as shown on a plan of land entitled "Plan of Land in (West) Barnstable, Massachusetts prepared for John & Paul Merlesena, Scale 1" =60', June 11, 1985, , Down Cape Engineering, Yarmouth, Mass.", which plan is duly recorded with the Barnstable County Registry of Deeds in Plan Book 406, Page 9.
Said land is conveyed together with the right to use the way shown on the aforementioned plan in common with others who are now or may hereafter become lawfully entitled thereto.
Said land is conveyed subject to a Declaration of Protective Covenants of the White Birch Subdivision recorded with said Deeds in Book 5047, Page 76, as amended in Book 6147, Page 265.
Said land is also conveyed subject to an Easement to New England Telephone & Telegraph Company et al dated May 5, 1986, recorded with said Deeds Book 5066, Page 312.
Said land is also conveyed subject to and with the benefit of all rights, restrictions, easements and appurtenances of record, if any, insofar as the same are now in force and applicable.
For mortgagor’s title see deed recorded with the Barnstable County Registry of Deeds in Book 35147, Page 339.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $10,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
