NOTICE OF INVITATION FOR BID
The Mississippi Oil and Gas Board (“MSOGB”) hereby gives notice that sealed proposals are sought and requested in order to retain the services of an Orphaned Well Plugging and Remediation Contractor (“Contractor”) qualified to do business in the State of Mississippi who will plug (if applicable), remediate, and reclaim orphaned oil and gas wells pursuant to a contract to be let by the MSOGB (IFB RFx No. 3160007670).
I.
Sealed bid proposals will be accepted by the office of the Board’s Supervisor at 500 Greymont Avenue, Suite E, Jackson, Mississippi 39202 until 2:30 p.m. on Friday, November 7, 2025. MSOGB staff will evaluate each submitted proposal and shall determine the lowest and best acceptable bid. The MSOGB reserves the right to reject any and all bids. The criteria for determining the lowest and best bid shall be as follows: All bids will be reviewed first to determine whether a bidder is responsive, responsible, and/or acceptable. Requirements are not assigned a point percentage and/or score, but are instead simply recorded as PASS or FAIL. Bids with errors that do not alter the substance of the bid can be accepted and the MSOGB’s designated representative may allow the bidder to correct the problem prior to review as long as the irregularities are insignificant mistakes that can be waived or corrected without prejudice to other bidders. The MSOGB has the right to waive minor defects or variations of a bid from the exact requirements of the specifications that do not affect the price, quality, quantity, delivery, or performance time of the services being procured. If insufficient information is submitted by a bidder with the bid for the agency to properly evaluate the bid, the agency has the right to require such additional information as it may deem necessary after the time set for receipt of bids, provided that the information requested does not change the price, quality, quantity, delivery, or performance time of the services being procured. All bids which are determined to be responsive, responsible, and/or acceptable will continue on to the price bid or cost evaluation. The MSOGB shall determine the best acceptable bid based on the lowest cost evaluation, best value, qualifications, methodology, maximum capacity, and/or past experience of the Contractor.

ADVISORY: THE MSOGB SHALL NOT BE RESPONSIBLE FOR ISSUES RELATED TO SEALED PROPOSALS SUBMITTED THROUGH THE UNITED STATES MAIL. SHOULD ANY ISSUES ARISE WHICH RENDER SUBMITTED PROPOSALS UNABLE TO BE OPENED, THE MSOGB WILL PROCEED AS SCHEDULED IN OPENING ALL OTHER SEALED PROPOSALS RECEIVED BY THE OFFICE AS OF THE DATE AND TIME STATED ABOVE.
II.
Proposals must be made in accordance with the form of proposal which may be obtained from the MSOGB. The form of proposal and all questions related to the proposal or bid package should be directed to Missy Zebert at the address, telephone number and/or email address provided above.
III.
Proposals shall be made and received upon the following conditions:
a. Each proposal must be accompanied by a bidders bond executed by a surety company authorized to do business in the State of Mississippi, a letter of credit in a form suitable to the Supervisor, or other financial guarantee in a form suitable to the Supervisor (a company check is acceptable) in the principal amount of not less than $500.00, conditioned that if the proposal is accepted, the successful bidder will enter into a contract for the work and provide Certificate of Insurance proving coverage of general liability insurance of not less than $1,000,000.00.
b. All submittals of bonds, letters of credit or other financial guarantees, except that of a successful bidder, will be returned or refunded.
c. Upon acceptance of a bid, if the successful bidder fails to enter into a contract pursuant to the requirements of the MSOGB, the monies standing to the credit of the same shall be forfeited to the MSOGB as liquidated damages.
