Notice of Oil and Gas Lease Forfeiture
Pursuant to Section 5301.332 of the Ohio Revised Code
Notice is hereby given to Columbia Gas Transmission, LLC, a Delaware limited liability company, The Columbus Natural Gas Company, an Ohio corporation, and The Ohio Central Gas Company, an Ohio corporation, and their unknown successors and assigns of the following:
Elizabeth Foster Gibson, individually, and Karl E. Foster III, Trustee of the Foster Family Trust dated September 3, 2001 (collectively, the "Fosters") are current lessors under a Memorandum of Agreement by and between N.C. Brown Sr., as lessor, and The Columbus Natural Gas Company, as lessee, dated May 10, 1909, and recorded at Lease Record Volume 21, Page 638 of the Licking County, Ohio Recorder's Office (the "Lease"). The Lease covers the following premises:
"All that certain lot of land situated in Section,…Township of Union, County of Licking, State of Ohio, and bounded and described as follows; to wit:
Bounded on the North by the land of Linnie Grove, A. Hillbrank & F. King.
Bounded on the East by the land of James Black & Clara Ruffner;
Bounded on the South by the land of T. F. hillbrant & James Black;
Bounded on the West by the land of Olvia Lees & Linnie Grove & A. Hillbrant.
Containing 121 acres, be the same more or less, and being all the land owner by Grantor in said home farm."
The Lease has a primary term of one (1) year and as much longer as oil or gas is found in paying quantities, on the following conditions: If gas only is found, second party agrees to pay $200.00 Dollars each year for the product of each well while the same is being sold off the premises, payable semi-annually in advance, the first party to have gas free of cost to heat all stoves for lights in dwelling house during same time.
The Fosters are the current owner of Parcel No. 725-326286-00.000, containing 65.66 acres, more or less, located in the State of Ohio, County of Licking, City of Heath (formerly assessed as Parcel No. 071-326286-00.000 when part of Union Township), as described in an (i) Amended Certificate of Transfer No. 1 dated December 17, 2024, and filed of record as Instrument No. 202412310023142, (ii) Certificate of Transfer No. 1 dated November 14, 1996, and filed of record in Official Record Volume 859, Page 760, and (iii) Plat of Territory to be Annexed From the Township of Union to the City of Heath dated January 11, 2024, and filed of record as Instrument Number 202504170006619, both in the Recorder's Office, Licking County, Ohio. The foregoing property comprises a portion of the leasehold premises.
Pursuant to Section 5301.332 of the Ohio Revised Code, the Lease has been forfeited as there are no producing or drilling oil or gas wells drilled on the leasehold premises and (i) covenants of the Lease regarding production have been breached; and/or (ii) the term of the Lease has expired. The Fosters intend to file for record an affidavit of forfeiture with the Licking County, Ohio Recorder's Office if the parties being notified hereby do not release the Lease of record within thirty (30) days of the publication of this notice.
