Notice of Oil and Gas Lease Forfeiture
Pursuant to Section 5301.332 of the Ohio Revised Code
Notice is hereby given to Tori R. Todd, Jennifer S. Todd, and/or their unknown heirs and assigns; the unknown heirs and assigns of George Todd, deceased; Frank Barton, dba Noramco, Inc., Patrick C. Fagan, dba Peace Oil and Gas Company, Eastern Gas Transmission, Inc., an Ohio corporation, and Buckeye Management Company, an Ohio corporation, and their unknown heirs, successors, and assigns of the following:
Russell Family Limited Liability Company, an Ohio limited liability company ("Russell Family LLC"), is the current lessor under an Oil and Gas Lease by and between Bennett O. Lees and Ethel R. Lees, as lessors, and Buckeye Management Company, as lessee, dated October 23, 1974, and recorded at Lease Record Volume 129, Page 559 of the Licking County, Ohio Recorder's Office (the "Lease"). The Lease covers the following premises:
"[T]he following described tract of land situated in the Township of Union, County of Licking, State of Ohio, and containing 198.00 acres, more or less, and being the same land conveyed to lessor by deed from _____________ dated ______ and recorded in Book ______, page ______, in the recorder's office in said county, together with all additional land owned or claimed by lessor which adjoins the land above described, whether situated in the same or other township, bounded substantially as follows:
On the North by lands of DeFrance; D. Lees; Foster Cooperrider
On the East by lands of D. Lees; Cooperrider
On the South by lands of R. Black; E. Rees; W. Gulick
On the West by lands of W. Gulick; Darkes; Sm. Tr."
The Lease has a primary term of 3 years and as much longer thereafter as oil or gas, or either of them is produced. If no well is commenced on the leasehold premises within 12 months of the date of the Lease, the grant therein becomes null and void, unless on or before that date the lessee of the Lease pays or tenders the lessor a delay rental of $198 in advance for each year thereafter a well is not completed on the leasehold premises, up to a maximum of 3 years.
Russell Family LLC is the current owner of Parcel No. 725-326448-00.000 containing 146.95 acres, more or less, located in the City of Heath (formerly within Union Township), County of Licking, State of Ohio, as described in Quitclaim Deed dated December 27, 2005, and filed of record as Instrument Number 200512270040711 and (ii) Plat of Territory to be Annexed From the Township of Union to the City of Heath dated October 18, 2023, and filed of record as Instrument Number 202310190019246, both of the Recorder's Office, Licking County, Ohio. The foregoing property comprises a portion of the leasehold premises.
Pursuant to Section 5301.332 of the Ohio Revised Code, the Lease has been forfeited as there are no producing or drilling oil or gas wells on the leasehold premises and (i) covenants of the Lease regarding production have been breached; and/or (ii) the term of the Lease has expired. Russell Family LLC intends to file for record an affidavit of forfeiture with the Licking County, Ohio Recorder's Office if the parties being notified hereby do not release the Lease of record within thirty (30) days of the publication of this notice.
