Notice of Oil and Gas Lease Forfeiture Pursuant to Section 5301.332 of the Ohio Revised Code Notice is hereby given to Columbia Gas Transmission, LLC, a Delaware limited liability company, The Columbus Natural Gas Company, an Ohio corporation, and The Ohio Central Gas Company, an Ohio corporation, and their unknown successors and assigns of the following: Russell Family Limited Liability Company, an Ohio limited liability company ("Russell Family LLC"), is the current lessor under an Oil and Gas Lease by and between T.F. Hillbrant, as lessor, and John W. Smith, as lessee, dated January 5, 1903, and recorded at Lease Record Volume 7, Page 62 of the Licking County, Ohio Recorder's Office (the "Lease"). The Lease covers the following premises: "All that certain tract of land situated in the township of Union, County of Licking, in the state of Ohio, bounded and described as follows towit; Bounded on west by lands of W.H. Owens and Willie Lee, Bounded on the east by lands of T.F. Hillbrant, On the south by lands of W.M. Cunningham, On the west by lands of Elmer Ewing[.] Containing One hundred and sixty acres, more or less." The Lease has a primary term of 5 years and as much longer as oil or gas is found or produced thereon or the rental paid according to the terms of the Lease on the following conditions: If Gas only is found, lessee agrees to pay Two Hundred dollars each year in advance for the product of each well and the lessor to have gas free of cost to heat grates and stoves and lights and any other domestic purposes in dwelling house during the same time. If no well is completed on the leasehold premises within ninety (90) days from the date of the Lease, the grant therein shall become null and void unless the lessee shall pay to the lessor a rental of Two Hundred dollars in advance for each year thereafter such completion is delayed for up to a maximum of 5 years. Russell Family LLC is the current owner of Parcel No. 725-326448-00.000 containing 146.95 acres, more or less, located in the City of Heath (formerly within Union Township), County of Licking, State of Ohio, as described in Quitclaim Deed dated December 27, 2005, and filed of record as Instrument Number 200512270040711 and (ii) Plat of Territory to be Annexed From the Township of Union to the City of Heath dated October 18, 2023, and filed of record as Instrument Number 202310190019246, both of the Recorder's Office, Licking County, Ohio. The foregoing property comprises a portion of the leasehold premises. Pursuant to Section 5301.332 of the Ohio Revised Code, the Lease has been forfeited as there are no producing or drilling oil or gas wells on the leasehold premises and (i) covenants of the Lease regarding production have been breached; and/or (ii) the term of the Lease has expired. Russell Family LLC intends to file for record an affidavit of forfeiture with the Licking County, Ohio Recorder's Office if the parties being notified hereby do not release the Lease of record within thirty (30) days of the publication of this notice.
