Under and by virtue of the Power of Sale contained in a Security Deed given by Francie Walker to H&R Block Mortgage Corporation, dated December 20, 2005, and recorded in Deed Book 299S, Page 520, Chatham County, Georgia Records, as last transferred to U.S. Bank National Association, as Trustee for Asset Backed Securities Corporation Home Equity Loan Trust, Series OOMC 2006-HE3, Asset Backed Pass-Through Certificates, Series OOMC 2006-HE3 by assignment recorded on October 2, 2008 in Book 345G Page 594 in the Office of the Clerk of Superior Court of Chatham County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of One Hundred Two Thousand Six Hundred and 0/100 dollars ($102,600.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Chatham County, Georgia, within the legal hours of sale on November 4, 2025, the following described property:
LAND REFERRED TO IN THIS COMMITMENT IS DESCRIBED AS ALL THAT CERTAIN PROPERTY SITUATED IN CITY OF SAVANNAH IN THE COUNTY OF CHATHAM, AND STATE OF GA AND BEING DESCRIBED IN A DEED DATED 10/29/2003 AND RECORDED 11/18/2003 IN BOOK 261 PAGE Z/424 AMONG THE LAND RECORDS OF THE COUNTY AND STATE SET FORTH ABOVE, AND REFERENCED AS FOLLOWS:
ALL THAT CERTAIN LOT, TRACT OR PARCEL OF LAND SITUATE, LYING AND BEING IN THE CITY OF SAVANNAH, COUNTY OF CHATHAM, STATE OF GEORGIA AND BEING KNOWN AND DESIGNATED AS LOT NUMBER TWENTY-THREE (23), PARADISE PARK SUBDIVISION, AS SHOWN ON A MAP OR PLAN OF SAID SUBDIVISION RECORDED IN THE CLERKS OFFICE OF THE SUPERIOR COURT OF CHATHAM COUNTY, GEORGIA IN SUBDIVISION MAP BOOK A, FOLIO 233 A & B, SAID LOT HEREBY CONVEYED HAVING A FRONTAGE OF SEVENTY-FIVE (75) FEET ON THE NORTHERLY SIDE OF DYCHES DRIVE WITH A DEPTH NORTHWARDLY OF ONE HUNDRED TWENTY-FIVE (125 FEET) FEET AND BEING BOUNDED AS FOLLOWS: ON THE NORTH BY PORTIONS OF LOT THIRTY-EIGHT (38), AND THIRTY-NINE (39), SAID SUBDIVISION; ON THE BATS BY LOT TWENTY-FOUR (24), SAID SUBDIVISION; ON THE SOUTH BY DYCHES DRIVE; AND ON THE WEST BY LOT TWENTY-TWO (22), SAID SUBDIVISION. SAID MAP OR PLAN IS HEREBY INCORPORATED INTO THIS DESCRIPTION BY REFERENCE AND MADE A PART HEREOF TO BETTER DETERMINE THE METES, BOUNDS, COURSES AND DISTANCES OF THE PROPERTY HEREIN CONVEYED.

The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney’s fees (notice of intent to collect attorney’s fees having been given).
The entity having full authority to negotiate, amend or modify all terms of the loan (although not required by law to do so) is: PHH Mortgage Corporation they can be contacted at 1-800-750-2518 for Loss Mitigation Dept, or by writing to 1661 Worthington Rd., Ste. 100, West Palm Beach, Florida 33409, to discuss possible alternatives to avoid foreclosure.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the property is Libertas Investments, LLC or tenant(s); and said property is more commonly known as 4 Dyches Dr, Savannah, GA 31406.
The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code (2) final confirmation and audit of the status of the loan with the holder of the security deed and (3) any right of redemption or other lien not extinguished by foreclosure.
