Under and by virtue of Power of Sale contained in the Security Deed from Thalisia Nechille Kelley and Juriesha Ja Quan Johnson, to Vanderbilt Mortgage and Finance, Inc., dated October 26, 2023, filed for record November 7, 2023, recorded at Deed Book 640, Page 146, Jefferson County, Georgia Records, in the original principal amount of $137,183.19, aforesaid records together with a Promissory Note of equal date and value, with interest at the rate specified therein, there will be sold, by the undersigned at public outcry to the highest bidder for cash, before the Courthouse Door, or designated area at JEFFERSON COUNTY, Georgia, or designated area, within the legal hours of sale on the first TUESDAY in NOVEMBER 2025, the following described property:
All that tract or parcel of land, with improvements thereon, situate, lying and
being in the 77th District G.M. of Jefferson County, Georgia, consisting of 0.90 acres, more or less, and bounded, now or formerly, on the North by lands of H.T. Howell, Sr.; on the East by lands, now or formerly of Willie Walker; on the South by the Public Road #88 and on the West by lands, now or formerly of H.T. Howell, Sr. Said tract of land is more particularly described by a Plat of Survey made on May 11, 1968, by Herman May, County Surveyor, of Glascock County, Georgia, a copy of said Plat being recorded in the Office of the Clerk of the Superior Court of Jefferson County, Georgia, in Deed Book 78, Pages 290-291, said Plat is incorporated herein and made a part hereof by reference.
THIS BEING the same property conveyed to the Mortgagor by deed from David Lee Scott, Jr., recorded on 10/28/2020 in the Office of the Clerk of Superior Court for Jefferson County in Deed Book 604, Page 723.
Said legal description is controlling but the property is commonly known as 4895 GA Highway 88, Wrens, GA 30833.
Tax and Parcel ID Number: 0115-011.
The indebtedness secured by said Security Deed has been and is hereby declared due because of default under the terms of said Security Deed and Note, including, but not limited to, the nonpayment of the indebtedness as and when due. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorneys' fees and other payments provided for under the terms of the Security Deed and Note.
Said property will be sold subject to the following items which may affect the title to said property: all zoning ordinances; matters which would be disclosed by an accurate survey or by inspection of the property; any outstanding taxes, including but not limited to, ad valorem taxes, which constitute liens upon said property; special assessments; and all outstanding bills for public utilities which constitute liens upon said property; To the best of the knowledge and belief of the undersigned, the party in possession of the property is Thalisia Nechille Kelley and Juriesha Ja Quan Johnson, and /or tenant(s).
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the United States Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed.
