NOTICE is hereby given that on September 26, 2025, Arthur A. Johnson of Arthur G. Johnson Trust, 6800 Cordova Circle Las Cruces NM, 88007, filed with the STATE ENGINEER Application No.: LRG-8331, OSE File No.: LRG-5310-A, for Permit to Change Point of Diversion within the Lower Rio Grande Underground Water Basin of the State of New Mexico by discontinuing the use of well LRG-5130 located within in the NW¼ SW¼ NW¼ of Section 32, Township 23 South, Range 2 East, NMPM, on land owned by the applicant, and instead use well LRG-8331 located within the NW¼ SW¼ NW¼ of said Section 32, more specifically at X = 1,480,346 feet, Y = 461,203.8 feet (NAD83), on land owned by the applicant, for the continued diversion of the amount of water subject to all conditions and provisions contained in the August 22, 2011 Final Judgment and Settlement Agreement in Stream System Issue No. 101, SS-97-101, combined with surface water from the Elephant Butte Irrigation District for the irrigation 1 acre of land, owned by the applicant. Wells LRG-5310 and LRG-8331 are located SW of Mesilla Park, NM and may be found immediately NE of the intersection of Arbor and Watson Rd. Dona Ana is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Las Cruces Sun News. To view the application and supporting documentation contact the State Engineer District Office to arrange a date and time for an appointment located at 1680 Hickory Loop, Suite J, Las Cruces, NM 88005. Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer's complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval l of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 1680 Hickory Loop, Suite J, Las Cruces, NM 88005 on or before December 12, 2025. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, at 575-524-6160. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
