Successor Trustee to Darlene T. Kanz, Deceased, Trustee of the Darlene Kanz Trust dated May 20, 1999 and amended and restated February 28, 2018; Successor Trustee to Darlene T. Kanz, Deceased, Trustee of the Darlene T. Kanz Trust dated October 10, 2005; Unknown Heirs and Devisees of Darlene T. Kanz; JOHN DOES I-V, inclusive; JANE DOES I-V, inclusive; BLACK CORPORATIONS I-V, inclusive; WHITE PARTNERSHIPS I-V, inclusive; Unknown Heirs and Devisees of each of the above-named Defendants, if deceased, Defendant(s).
UNDER AND BY VIRTUE OF EXECUTION AND ORDER OF SALE issued out of and under the seal of Superior Court of Maricopa County, State of Arizona, on the 21st day of August, 2025, and to me as Sheriff of said County duly directed and delivered in the above entitled action:
WHEREAS, on the 2nd day of July, 2024, the above-named Plaintiff recovered a Judgment in the above-styled Court against the Defendant, above-named, as follows:
The sum of $19,390.20 for principal, charges, advances and expenditures; Pre-judgment interest at the rate of 10% on unpaid delinquent assessments from April 2023 in the amount of $1,362.84; Plaintiff’s attorneys’ fees in the amount of $3,708.00; Plaintiff’s Court costs in the amount of $812.00; Interest pursuant to A.R.S. §44-1201 on said principal at the 10%, and on the attorneys’ fees and Court costs at the current statutory rate of nine and a half percent (9.5%) per annum from the date of judgment until paid, together with accruing costs; and together with such advances for assessments, taxes, insurance and maintenance as are reasonably and necessarily made by the Plaintiff with respect to the premises from this date until sold as hereinafter ordered.
WHEREAS, the amount due and owing as of this date is the total of all foregoing judgment amounts, after all setoffs and credits have been allowed is:
Judgment -- $25,273.04; Unpaid assessments from date of Judgment -- $8,876.00; Unpaid late charges from date of Judgment -- $895.40; Post Judgment Fees and Costs: not yet awarded -- $0.00; Less: Payments received since date of Judgment -- ($0.00); TOTAL (not including post-judgment interest) -- $35,044.44, plus costs of Sheriff’s Sale, together with a foreclosure of Plaintiff’s lien against the Defendant, on the following described real property, to-wit:
Parcel No. 1: All improvements located on the following: Unit 163-D2, of CASA DEL MONTE, according to Declaration of Horizontal Property Regime recorded in Docket 10520, Page 419; First Amendment Recorded in Docket 12040, Page 584 and Re-recorded in Docket 12087, Page 370; and Second Amendment Recorded in Docket 12366, Page 488, and per Map recorded in Book 170 of Maps, Page 20 in the Office of the County Recorder of Maricopa County, Arizona. TOGETHER WITH a proportionate interest in and to the common areas, as set forth in said Declaration of Horizontal Property Regime and as shown on said plat. Parcel No 2: Unit 163-D2, of CASA DEL MONTE, according to Declaration of Horizontal Property Regime recorded in Docket 10520, Page 419; First Amendment recorded in Docket 12040, Page 584 and Re-recorded in Docket 12087, Page 370; and Second Amendment recorded in Docket 12366, Page 488, and per map recorded in Book 170 of maps, Page 20 in the Office of the County Recorder of Maricopa County, Arizona. TOGETHER WITH a proportionate interest in and to the common areas, as set forth in said Declaration of Horizontal Property Regime and shown on said plat. Except all improvements located thereon.
AKA: 4525 N 66th St #7 Scottsdale, AZ 85251.
That the period of redemption of said Defendant-Mortgagors, their successors in interest and all of them be limited and restricted to thirty (30) days after the date of sale in accordance with A.R.S. 12-1282 (A) as amended.
NOW, THEREFORE, PUBLIC NOTICE IS HEREBY GIVEN that on the 6th day of November, 2025, at the hour of 10:00 A.M. at 301 West Jefferson Street, Room 250-8*, in the City of Phoenix, Maricopa County, State of Arizona, I will in obedience to said Execution and Order of Sale, sell all the right, title, claim and interest of the above named debtor, in, of and to the above described property at public auction to the highest bidder for cash or certified funds only, in lawful money of the United States, and apply the proceeds thereof to the payment and satisfaction of said judgment, together with the interest that may be due thereon and all costs of suit and accruing costs.
