NOTICE OF ADOPTION OF ORDINANCE FOR VOLUNTARY ANNEXATION Notice is hereby given that, on the 20th day of October, 2025, the Town Council for the Town of Yorktown, Indiana, adopted Ordinance No. 867 pursuant to Ind. Code § 36-4-3-5.1 approving the annexation of approximately 9.05 acres of land located in Delaware County and known generally as 1301 N. Nebo Rd. (the "Annexation Ordinance"). A copy of the Annexation Ordinance is on file in the office of the Clerk-Treasurer for the Town of Yorktown at the Yorktown Municipal Building, located at 9312 W. Smith Street, Yorktown, Indiana 47396 and is available for inspection upon request. Not later than thirty (30) days after publication of this Notice, owners of land within one-half mile of the annexed property, or any municipality within Delaware County, may appeal the adoption of the Annexation Ordinance to a Delaware County Circuit Court on the basis that the annexed area is not contiguous to the annexing municipality. In the absence of an appeal, the Annexation Ordinance shall take effect not less than thirty (30) days after publication of this Notice and upon the filing and recording of the Annexation Ordinance pursuant to the requirements of Ind.
