MORTGAGEE'S NOTICE OF SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain Mortgage, given by Todd A. Soucie and Kimberly R. Soucie F/K/A Kimberly R. Barnes  (the "Mortgagor"), to Workers Credit Union, a lending institution, with a usual place of business at 119 Russell Street, Littleton, MA 01460 (the "Mortgagee"), dated August 31, 2005, and recorded at Worcester District Registry of Deeds in Book 37226, Page 328, (the "Mortgage"), of which Mortgage the undersigned is the present holder, for breach of the conditions of the Mortgage and for purposes of foreclosing the same will be sold at Public Auction at 10 o'clock AM on December 2, 2025 on the premises located at 232 Arlington Street, Athol, Massachusetts, which are all and singular the premises described in the Mortgage,
TO WIT: A certain parcel of land situated in Athol in the County of Worcester and said Commonwealth being known as and designated as Lot 1 on a plan entitled "Plan of Land in Athol, Massachusetts, owned by and prepared for LDG Realty and Trust, 42 Beal Street, Lunenburg, Massachusetts 01460 Scale 1" = 60' December 11, 1986, Rubin Engineering, One Grafton Common, P.O. Box 502, Grafton, MA 01519 (617) 839-9526," recorded with Worcester District Registry of Deeds, Plan Book 576, Page 65. Together with the benefit of and subject to an easement to be for the purpose of laying, erecting maintaining and operating over, through and upon the same, water and sewer pipes as may be reasonable and proper, to make good, nevertheless at the expense of the owner of Lot 1, all damage which may be caused thereby Lots 4 and 5. Said easement to be for the benefit of the owners of Lot 1, their successors, assigns and grantees. Said easement is shown on a plan entitled "Easement Plan Over Lot(s) 4 & 5 Athol, Massachusetts, owned by and prepared for L.D.G. Realty Trust, 66 West Street, Leominster, MA 01453 Scale 1" = 60' April 27, 1987, Rubin Engineering, One Grafton Common, P.O. Box 502, Grafton, MA 01519 (617) 839-9526," see Plan Book 576, Page 66. Subject to possible rights of others in a westerly extension of Wachusett Avenue, and a southerly extension of Wachusett Avenue, and a southerly extension of Arlington Street. Subject to and with the benefit of restrictions, easements and covenants of record so far as the same may now be in force and effect. Being the same premises conveyed to us by deed of Beverly J. Taylor, dated January 31, 2000 and recorded with said Registry, Book 22279, Page 72.
The description of the premises contained in said Mortgage shall control in the event of a typographical error in this publication.
The premises being offered for sale will be sold subject to any and all restrictions, easements, covenants, conditions, agreements, outstanding tax titles, unpaid real estate taxes, and other municipal and public charges, assessments, liens or claims in the nature of liens, rights of others in adjacent streets and ways, and existing encumbrances of record created prior to the mortgage, if any there be, and also subject to all federal, state and municipal laws, regulations, codes and ordinances.
TERMS OF THE SALE: A deposit of Five Thousand Dollars ($5,000.00) by bank or certified check, will be required to be paid by the highest bidder at the time and place of the sale and said bidder will be required to sign a Memorandum of Sale containing the above and any announced terms. The sale will not be complete until such deposit is paid and such Memorandum is signed. In the event the successful bidder at the public auction fails to perform in the time specified to purchase the premises, the Mortgagee reserves the right, at its sole election, to sell the premises by foreclosure deed to the other qualified bidders, in descending order beginning with the next highest bidder and reserves the right, at its sole election, to assume the bid of any defaulting or declining bidder. The Purchaser will be required to deliver the balance of the bid price by bank or certified check within thirty (30) days of the date of the auction sale, at the law firm of Gelinas & Ward, LLP, 106 Merriam Avenue, Leominster, MA  01453 at which time the foreclosure deed and all related documents will be delivered to the Purchaser.  The Purchaser will be solely responsible for filing and recording foreclosure documents and for the payment of deed excise stamps and filing and recording fees.  The Mortgagee may postpone the sale by public proclamation at the original or postponed time and date of sale.
