NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
Premises: 5C Fulling Mill Lane, Hingham, Massachusetts
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Paul J. Ryan to Mortgage Electronic Registration Systems, Inc. ("MERS"), as mortgagee, as nominee for Family Choice Mortgage Corporation its successors and assigns and now held by Manufacturers And Traders Trust Company Also Known As M&T Bank Successor By Merger To Hudson City Savings Bank, FSB, said mortgage dated May 2, 2003, and recorded in the Plymouth County Registry of Deeds in Book 25009, Page 194, as affected by an Assignment of Mortgage dated September 7, 2010, and recorded in the Plymouth County Registry of Deeds in Book 38979, Page 226, as affected by an Assignment of Mortgage dated June 26, 2013, and recorded in the Plymouth County Registry of Deeds in Book 43283, Page 50, of which mortgage the undersigned is the present holder, for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on November 13, 2025 at 12:00 PM Local Time upon the premises, all and singular the premises described in said mortgage, to wit:
That certain parcel of land in Hingham, Plymouth County, Massachusetts, being bounded and described as follows:
Westerly: by the sideline of Main Street, a public way 150.00 feet;
Northerly: By Lot #6 on the Definitive Plan hereinafter described, 300.36 feet;
Easterly: by Lot #6 on the Definitive Plan hereinafter described, 120.98 feet;
Southerly: by land now or formerly of Linda I. Glen, 299.83 feet.
The parcel conveyed hereby is shown as Lot #7 on a definitive Subdivision Plan entitled "Subdivision Plan of Fulling Mill Farm, Hingham Mass." date March 7, 1980 and most recently revised July 24, 1980 and recorded with the Plymouth County Registry of Deeds in four sheets at Plan no 509 of 1980 in Plan Book 21, Page 917.
The parcel conveyed hereby is subject to easements for Walkways and Bridle Paths all as shown on Plan#42 of 1981 at the Plymouth County Registry of Deeds and is further subject to and with the benefit of those easements, restrictions, benefits and burdens as contained in FULLING MILL FARM Amended Declaration of Easements and Restrictions dated January 27, 1981, recorded with the Plymouth County Registry of Deeds at Book 4946 and Page 391 to which reference is made for more complete descriptions of the same. This parcel is also subject to an easement for electric and telephone services more particularly described in an instrument recorded with the Plymouth Registry of Deeds at Book 4946 at Page 409.
The parcel conveyed hereby is further conveyed with the benefit of a restriction that vehicular access and egress to Lots #4, #6 and #7 are prohibited except over the portions of Lots #3 and #6 designated as the "16 Common Drive." This restriction is declared to exist to exist for the mutual benefit of those Lots and Lot #3 and for the benefit of the FULLING MILL FARM HOME OWNER'S ASSOCIATION TRUST as previously mentioned. The mutual restriction and benefit shall encumber both these lots and Lot #3 unless earlier and specifically modified, so long as the duration of the easements, restrictions and benefits set forth in the FULLING MILL FARM Amended Declaration of Easements and Restrictions previously described. Lots #4, #6 and #7 are subject to the imposition of a special charge for the repair, maintenance, plowing and replacement of said Common Drive in the following proportions of the expenses of such work, namely, Lot #3: 0%, Lot #4: 15%, Lot #6: 36%, and Lot #7: 40% to be assessed and collected in the manner set forth in the FULLING MILL FARM HOME OWNERS' ASSOCIATION TRUST recorded with the Plymouth County Registry of Deeds in Book 4946, at Page 401.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
For Mortgagor's Title see deed dated May 2, 2003, and recorded in the Plymouth County Registry of Deeds in Book 25009, Page 192.
TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid by a certified check, bank treasurer's or cashier's check within forty-five (45) days after the date of sale.
