NOTICE OF DETERMINATION TO CONSTRUCT AND FINANCE IMPROVEMENTS TO THE SEWAGE WORKS OF THE CITY OF WEST LAFAYETTE, INDIANA, AND THE ADOPTION AND PURPORT OF THE ORDINANCE AUTHORIZING THE SAME Property owners and other interested parties in the City of West Lafayette, Indiana (the "City"), are hereby notified that on November 3, 2025, the Common Council of the City adopted Ordinance No. 45-2025 (the "Ordinance") thereby making a determination and order to finance and undertake the construction, acquisition, installation, and equipping of certain improvements to the sewage works system of the City, together with any other projects related thereto, and expenses incurred in connection with or on account of the issuance of bonds for such purpose (collectively, the "Project"). The cost of the Project, including incidental expenses, is estimated to be in an amount not to exceed $8,100,000. The Ordinance further directed and ordered the cost of the Project to be financed by the issuance of sewage works revenue bonds in one or more series in an amount not to exceed $8,100,000, and, if necessary, bond anticipation notes ("BANs") in an amount not to exceed $8,100,000. The bonds will be payable solely from the net revenues of the sewage works system. The bonds may be sold at a public sale or a negotiated sale pursuant to Indiana Code 5-1-11, at an interest rate not to exceed seven percent (7.00%) per annum. Alternatively, the bonds may be sold to the Indiana Finance Authority, to the Indiana Bond Bank, or to an underwriter or a financial institution selected by the City. Each series of bonds shall have a maximum term ending no later than thirty-five years after the date of issuance of the Bonds or five years after the date of issuance of the BANs. A copy of the Ordinance may be examined at the Office of the Clerk, located at City Hall, 222 North Chauncey Avenue, West Lafayette, Indiana 47906. Objections to the Project and the bonds may be filed in the time and manner provided by Indiana Code 36-9-23. Dated this 4th day of November, 2025.
