MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Sandra Vieira to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for IndyMac Bank, F.S.B., its successors and assigns, dated November 21, 2007 and recorded in Bristol County (Southern District) Registry of Deeds in Book 8871, Page 143 (the “Mortgage”), as affected by a Loan Modification Agreement dated August 20, 2018, and recorded at said Registry of Deeds in Book 12573, Page 224 of which mortgage PHH Mortgage Corporation is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., as designated nominee for IndyMac Bank, F.S.B., beneficiary of the security instrument, its successors and assigns to Ocwen Loan Servicing, LLC dated August 19, 2014 and recorded at said Registry of Deeds in Book 11155, Page 107, and Assignment from Ocwen Loan Servicing, LLC to PHH Mortgage Corporation dated April 25, 2019 and recorded at said Registry of Deeds in Book 12776, Page 214, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 60 Erin Court, New Bedford, MA 02745 will be sold at a Public Auction at 1:00 PM on November 19, 2025, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
The land and any building thereon in New Bedford, Bristol County, Massachusetts, bounded and described as follows:
BEGINNING at a point in the easterly sideline of Erin Court, said point being the northwesterly corner of Lot 59 as shown on the plan of land hereinafter referenced and the southwesterly corner of the premises herein described; thence
NORTH 87 degrees 43' 9" EAST by the northerly sideline of the said Lot 59, one hundred seventeen and 51/100 (117.51) feet to a point for a corner in the westerly sideline of Parcel "D" as shown on sad Plan; thence
NORTH 9 degrees 26' 26" WEST by said Parcel "D" sideline, sixty-seven and 32/100(67.32) feet to a point for a corner and the southeasterly corner of Lot 61 as shown on said Plan,; thence
NORTH 89 degrees 54' 19" WEST by the southerly sideline of the said LOT 61, one hundred three and 09/100 (103.09) feet to a point for a corner in the easterly sideline of the Erin Court cul-de-sac; thence
SOUTHWESTERLY by said Erin Court cul-de-sac in the arc of a curve to the right having a radius of fifty and no/100 (50.0) feet, nine and 48/100 (9.48) feet to a concrete bound; thence
CONTINUING SOUTHWESTERLY by said Erin Court sideline in the arc of a curve to the left having a radius of thirty and no/100 (30.0) feet to a concrete bound; and thence
SOUTH 11 degrees 9' 0" EAST still by said sideline, thirty-nine and 71/100 (39.71) feet to a point for a corner, the northwesterly corner of the said LOT 59, and the point of beginning.
Being shown as LOT 60 on a plan entitled "Woodford Estate Definitive Subdivision Plan of Land in the City of New Bedford, Bristol County, Massachusetts Prepared for Wayland Development Corp., Date: February 6, 2002., Revised April 10, 2002, Scale: 1" =40"', drawn by Prime Engineering, Inc. of Lakeville, MA, and filed in the Bristol County (S.D.) Registry of Deeds in Plan Book 149, page 110.
 
For mortgagor’s title see deed recorded with the Bristol County (Southern District) Registry of Deeds in Book 8343, Page 317.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee.
