Notice of Pending Application for Proposed Unconnected Pond via Nonmetallic Mining
Dan De Boer (on behalf of Earth, Inc), 4366 Dairy Road, Arpin, WI 54410 has applied to the Department of Natural Resources for a permit to create an artificial unconnected pond via nonmetallic mining adjacent to an unnamed waterway (WBIC1741200). The project is located in the SE 1/4, NE 1/4, Section 2, Township 23 North, Range 2 East located in the Town of Cary, Wood County, WI.
The project consists of an existing quarry that has been in operation since 2002 where a future pond will be created for part of the site as a result of mining. The excavated granite material will be stockpiled onsite until hauled off site by trucks to their final end use. The pond will be unconnected from any waterways and is proposed to be 11 acres in size when mining and reclamation are completed. The pond is proposed to be approximately 40 feet deep and will meet statewide eclamation standards.
The Department will review the proposal provided by the applicant and any information from public comments and the public informational hearing. The Department will determine whether the proposal complies with ss. 1.11, 30.19, 30.208, Wis. Stats., and ch. NR150, NR340 Wis. Adm. Codes.
The Department has made a tentative determination that it will issue the permit for the proposed activity.

If you are requesting a public informational hearing, the request must be emailed, verbalized, or postmarked within 20 days after the date this notice is published on the Department's website. A request for hearing must include the docket number or applicant name and specify the issues that the party desires to be addressed at the informational hearing.
If no hearing is requested, the Department may issue its decision without a hearing. If a public informational hearing is held, comments must be postmarked no later than 10 days following the date on which the hearing is completed.
The final decision may be appealed as indicated in the decision document.
