ORDINANCE NO. 2025-11
AN ORDINANCE TO AMEND THE DISPOSAL OF
SOLID WASTE RATES AND CHARGES FOR SOLID WASTE
COLLECTION AND DISPOSAL SERVICES RENDERED BY THE SEWER UTILITY OF THE TOWN OF NORTH LIBERTY, INDIANA
WHEREAS The Town of North Liberty (the “Town) is entering into a contract for the collection and disposal of solid waste generated within the Town with Republic Services for the years 2024 through 2028 (the “Contract”); and
WHEREAS Republic Services will be awarded the Contract because it was the lowest overall bidder; and
WHEREAS despite being the lowest bidder the contract rate is higher than the current rate established by the Town for solid waste collection and disposal; and
WHEREAS to cover the cost of the Contract a rate increase for solid waste collection and disposal must be effectuated in January 2024.
WHEREAS the Town Council for the Town of North Liberty, St. Joseph County, Indiana believes that it is economically necessary to increase the monthly solid waste collection and disposal rates and charges for 2024-2028 and that the same is in the best interest, welfare, health and safety of the citizens of the Town of North Liberty.
NOW, THEREFORE BE IT ORDAINED by the Town Council of the Town of North Liberty, St. Joseph County, Indiana, as follows:
That Section 4 of Ordinance No. 2023-08 entitled “Rates and Charges”, shall be amended to read as follows:
Section 4 – Rates and Charges:
For the collection and disposal of solid waste services rendered by the Sewer Utility, rates and charges shall be collected from the residents of each single-family residence in single family zoned areas and duplexes located in multi-family zoned areas, which rates and charges shall be payable as hereinafter provided:
a. Year 2026-2028 will be $16.00.
b. A late payment charge (penalty) equal to Ten Percent (10%) on the monthly charge shall be payable for monthly charges not paid by the due date.
c. Any and all billings, including the final billing, to tenants of dwellings not paid within thirty (30) days shall be billed to and be payable by the landlord of the rental dwelling. If not paid within fifteen (15) days thereafter, amounts past due shall be filed with the County for collection with the property taxes as allowed by law:
d. The billing and collection of all such solid waste collection and disposal charges and penalties shall be performed by the Sewer Utility of the Town of North Liberty as authorized by I.C. 36-9-23-25; and
e. Monthly charges shall be due and payable on the 15th day of each month for the current month and shall be payable at the North Liberty Town Hall, 300 S. Main Street, P.O. Box 515, North Liberty, Indiana.
Section 7 - Inconsistency of Existing Ordinances: If any other ordinance heretofore passed by the Town of North Liberty, St. Joseph County, Indiana is inconsistent with any of the provisions of this Ordinance, the provisions of this ordinance shall prevail.
Section 8 – Effective Date. This Ordinance shall be in full force and effect from and after its passage and publication according to law.
Section 9 – Constitutionality: If any section or part of this Ordinance be for any reason held unconstitutional or invalid by a court or competent jurisdiction that holding shall not affect the validity of the remaining portions of the Ordinance, but the remaining portions shall be and remain in full force and effect.
BE IT FURTHER ORDAINED, that the changes set forth above to Section 4 or Ordinance No. 2023-08 shall be effective January 1, 2026.
