NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
Premises: 66 Mill Street, Pembroke, MA 02359
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Scott A. Fitzgerald and Margaret J Spinazola to Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Aegis Wholesale Corporation, and now held by Metropolitan Life Insurance Company, said mortgage dated April 25, 2005 and recorded in the Plymouth County Registry of Deeds in Book 30426, Page 300, as affected by a Loan Modification dated December 16, 2015 and recorded in the Plymouth County Registry of Deeds in Book 46435, Page 7; said mortgage was assigned from Mortgage Electronic Registration Systems, Inc. to Countrywide Home Loans, Inc. by assignment dated March 11, 2008 and recorded with said Registry of Deeds in Book 35937, Page 271; said mortgage was assigned from Countrywide Home Loans, Inc. to Mortgage Electronic Registration Systems, Inc., as Mortgagee by assignment dated June 6, 2023 and recorded with said Registry of Deeds in Book 57991, Page 213; said mortgage was assigned from Mortgage Electronic Registration Systems, Inc., as Mortgagee to Metropolitan Life Insurance Company by assignment dated July 3, 2025 and recorded with said Registry of Deeds in Book 60112, Page 231; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on December 4, 2025 at 10:00 AM Local Time upon the premises, all and singular the premises described in said mortgage, to wit:
A certain parcel of land together with the buildings thereon situated in Pembroke, Plymouth County, Massachusetts, and being shown as Lot 2 on a plan of land entitled "Subdivision of Land in Pembroke, Mass, owned by V.S. Haseotes & Sons, Inc., dated October 9, 1985, by Carleton W. Garvey, Land Surveyor and Consultant, 36 West Street, Whitman, Mass.", recorded with Plymouth County Registry of Deeds in Plan Book 26, Page 661.
Said parcel containing 40,000 square feet, more or less, according to said plan.
BEING THE SAME PROPERTY CONVEYED TO SCOTT A. FITZGERALD AND MARGARET J. SPINAZOLA, AS JOINT TENANTS BY DEED FROM COLLETTE L. PIZZI, TRUSTEE OF THE 66 MILL STREET REALTY TRUST U/D/T DATED DECEMBER 30, 1987 DATED 09/08/2003 AND RECORDED 09/19/2003 IN THE REGISTER OF DEED'S OFFICE FOR PYLMOUTH COUNTY, MASSACHUSETTS, IN BOOK 26575 AT PAGE 310.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
For Mortgagor’s Title see deed dated September 8, 2003 and recorded in the Plymouth County Registry of Deeds in Book 26575, Page 310.
TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within thirty (30) days after the date of sale.
