NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Christopher Neurath to Bank of America, N.A., dated January 17, 2007 and registered at the Middlesex County (Southern District) Registry District of the Land Court as document number 1433014, and noted on certificate of title number 238610, of which mortgage the undersigned is the present holder, by assignment from:
Bank of America, N.A. to Specialized Loan Servicing, LLC, registered on September 18, 2017, Document No. 1770621, as noted on Certificate of Title No. 238610
NewRez LLC d/b/a Shellpoint Mortgage Servicing f/k/a Specialized Loan Servicing, LLC to U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for RCF 2 Acquisition Trust, registered on October 16, 2024, Document No. 1965452, as noted on Certificate of Title No. 238610
for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 9:00 AM on December 3, 2025, on the mortgaged premises located at 21 Byron Avenue, Lexington, Middlesex County, Massachusetts, all and singular the premises described in said mortgage,
TO WIT:
The land in Lexington, Middlesex County, Massachusetts, described as follows:
Southwesterly by Byron Avenue, fifty (50) feet;
Northwesterly by lot 19 as shown on plan hereinafter mentioned, one hundred thirteen and 90/100 (113.90) feet;
Northeasterly by land now or formerly of the Boston & Maine Railroad, fifty (50) feet; and
Southeasterly by lot 21 on said plan, one hundred thirteen and 45/100 (113.45) feet.
Said parcel is shown as lot 20 on said plan (Plan No. 1693¹).
All of said boundaries are determined by the Court to be located as shown on a subdivision plan, as approved by the Court, filed in the Land Registration Office, a copy of which is filed in the Registry of Deeds for the South Registry District of Middlesex County in Registration Book 185, Page 81, with Certificate 27527.
There is appurtenant to the above described land the right referred to in deed from John Butkus to Harvey S. Bacon, Trustee, dated July 16, 1924, being Document 57872.
There is also appurtenant to the above described land the right to use the land shown as passageway on said plan, as an open and unobstructed passageway forever, for all purposes for which a passageway is ordinarily used.
Together with the right to use Byron Avenue and Lockwood Road, as shown on said plan, for all purposes for which streets are commonly used.
The above described land is subject to a Taking by the Town of Lexington for laying out Byron Avenue and Estimated Assessment, Document 212306 and to an Order for construction of sewer in Byron Avenue and Assessment, Document 341553.
For mortgagor's(s') title see deed registered with Middlesex County (Southern District) Registry District of the Land Court as Document No. 1433013, as noted on Certificate of Title No. 238610.
These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE:
A deposit of Fifteen Thousand ($15,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Harmon Law Offices, P.C., 150 California St., Newton, Massachusetts 02458, or by mail to P.O. Box 610389, Newton Highlands, Massachusetts 02461-0389, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. The description of the premises contained in said mortgage shall control in the event of an error in this publication.
