By virtue and in execution of the Power of Sale contained in a certain mortgage given by Neil F. MacPherson, Dionne L. MacPherson to Beneficial Massachusetts Inc., dated January 28, 2006 and registered at the Plymouth County Registry District of the Land Court as document number 600674, and noted on certificate of title number 93960, of which mortgage the undersigned is the present holder, by assignment from:
Beneficial Massachusetts Inc. to U.S. Bank Trust, N.A., as Trustee for LSF8 Master Participation Trust, registered on August 2, 2018, Document No. 774800, as noted on Certificate of Title No. 93960
U.S. Bank Trust, National Association, not in its individual capacity but solely as Trustee for LSF8 Master Participation Trust to DLJ Mortgage Capital, Inc., registered on August 2, 2018, Document No. 774801, as noted on Certificate of Title No. 93960
DLJ Mortgage Capital, Inc. to Wilmington Savings Fund Society, FSB, not in its individual capacity but solely as Owner Trustee for the FLIC Residential Mortgage Loan Trust 1, registered on June 26, 2025, Document No. 862231, as noted on Certificate of Title No. 93960
for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 5:00 PM on December 5, 2025, on the mortgaged premises located at 73 Birch Street, Pembroke, Plymouth County, Massachusetts, all and singular the premises described in said mortgage,
TO WIT:
A CERTAIN PARCEL OF LAND SITUATED IN PEMBROKE, PLYMOUTH COUNTY, MASSACHUSETTS, BOUNDED AND DESCRIBED AS FOLLOWS:
BEING LOT 10 AS DETERMINED BY THE COURT TO BE LOCATED AS SHOWN ON SHEET 4 OF PLAN 32145A, WHICH IS FILED WITH CERTIFICATE OF TITLE NO 36688, THE SAME BEING COMPILED FROM A PLAN DRAWN BY DELANO & KEITH, SURVEYORS, DATED MAY 15, 1960, AUGUST 3, 1961, AUGUST 7, 1961, JANUARY 28, 1963, AND OCTOBER 3, 1964, AND ADDITIONAL DATA ON FILE IN THE LAND REGISTRATION OFFICE, ALL AS MODIFIED AND APPROVED BY THE COURT.
For mortgagor's(s') title see deed registered with Plymouth County Registry District of the Land Court as Document No. 432847, as noted on Certificate of Title No. 93960.
These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE:
A deposit of Ten Thousand ($10,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Harmon Law Offices, P.C., 150 California St., Newton, Massachusetts 02458, or by mail to P.O. Box 610389, Newton Highlands, Massachusetts 02461-0389, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. The description of the premises contained in said mortgage shall control in the event of an error in this publication.
