MORTGAGEE'S NOTICE OF SALE OF REAL ESTATE
By virtue and in execution of that certain mortgage given by Craig D. Laliberte to Savers Co-Operative Bank d/b/a Savers Bank, dated September 28, 2021, and recorded with the Worcester District Registry of Deeds at Book 66212, Page 305, for breach of conditions of said mortgage and for the purpose of foreclosing the same, said premises, and the buildings thereon, will be sold at Public Auction at 10:00 A.M. on the 11th day of December, 2025, on the mortgaged premises at 6 Cedar Pond Road, Sturbridge, Massachusetts, all and singular, the premises described in said mortgage:
To Wit:
The land with the buildings thereon situated in Sturbridge, Worcester County, Massachusetts, on the westerly shore of Cedar Lake, bounded and described as follows:
BEGINNING at a cement monument in the ground easterly of driveway near the northwesterly corner of cottage on land now or formerly of Hooker;
THENCE N. 39° 09’ W. by said Hooker land 60.3 feet to an iron pin in the ground near the high water line of said Lake in a cove;
THENCE in the same course 6.7 feet more or less to said high water line;
THENCE northerly by said high water line in said cove 33 feet more or less to land now or formerly of Bruinsma;
THENCE N. 83° 39’ E. by said Bruinsma land two feet more or less to an iron pin in the ground which is located 34.5 feet northerly from the iron pin in the ground last mentioned;
THENCE in the same course by said Bruinsma land 57.5 feet to an iron pin in the ground;
THENCE S. 36° 47’ E. by said Bruinsma land 22.8 feet to an iron pin in the ground;
THENCE in the same course by Bruinsma land 98.7 feet to an iron pin in the ground;
THENCE in the same course by said Bruinsma land one foot more or less to the high water line of said Lake;
THENCE southwesterly by the high water line of said Lake to a point opposite drill hole in retaining wall located about one half foot from the southeasterly face of said wall;
THENCE N. 39° 09’ W. by said Hooker land to said drill hole, which is located S. 54° 53’ W. 60.18 feet from the iron pin in the ground last mentioned;
THENCE in the same course by said Hooker land 57.65 feet to the point of beginning.
THE granted premises are shown on a plan by N.E. Leathers, Engr. Dated April 10, 1948, recorded in the Worcester District Registry of Deeds, Plan Book 151, Plan 66.
SUBJECT to the right of said Rudolph D. Jalbert et ux, their heirs and assigns, in common with the owners of granted premises above to take water from well on granted premises near the last course above set forth, and to maintain pipes from said well, with the right to enter to clean out said well and to repair and replace said pipes at their own expense, doing no unnecessary damage, said Rudolph D. Jalbert et ux, having agreed for themselves, their heirs and assigns to pay one half the cost of cleaning out and maintaining said well.
SUBJECT to a right of way over the existing driveway across the premises as shown on said plan, and together with a right of way over the existing driveway from the above described premises to Cedar Street, it being agreed that the location of the said driveway from the above described premises to Cedar Street may be changed at any point or points by Leona I. Greene, her heirs and assigns, to another location in substantially the same locality, provided that a suitable surface is furnished over the portion of the driveway as relocated, by the person causing the change to be made, but without obligation to maintain driveway as existing or as changed.
SUBJECT to the right to maintain electric and telephone wires granted to Webster & Southbridge Gas & Electric Co. by deed dated February 11, 1937 and recorded with said Deeds, Book 2689, Page 228, and subject to the following restrictions:
1. The premises shall not be used for purposes of any trade or business
2. No outhouses nor open drains for waste water shall be maintained on the premises, nor any waste water disposed of except through cesspools or septic tanks.
BEING the same premises conveyed to Craig D. Laliberte by deed from Robert A. Delemarre dated October 11, 2017 and recorded in the Worcester District Registry of Deeds, Book 57905, Page 166.
The description of the premises contained in the mortgage shall control in the event of a typographical error in this publication.
TERMS OF SALE: $5,000.00 non refundable deposit shall be paid in cash or bank cashier's check by the purchaser at the time and place of sale, and the balance to be paid in cash or by certified or bank cashier's check at the office of Howard B. D’Amico, P.C., 33 Waldo Street, Worcester, Massachusetts, 01608, within 30 days of the sale. All bidders must exhibit said required deposit to the auctioneer immediately prior to the auction sale in order to qualify as a bidder.
Said premises will also be sold subject to and/or with the benefit of any and all rights of way, easements, restrictions, covenants, conditions, reservations and agreements of record, to the extent that the same are in force and applicable, outstanding taxes, tax titles, municipal or other public liens or assessments, water bills, sewer bills, liens or claims in the nature of liens, all existing encumbrances of record created prior to this mortgage, and the right of redemption of the United States of America, if any. It shall be the bidders’ sole responsibility to ascertain all items described in this paragraph and no representations are made concerning compliance with applicable zoning regulations. The mortgaged premises, if occupied, shall be conveyed subject to existing occupancies and/or tenancies.
This sale may be postponed or adjourned from time to time, if necessary, by the Attorney for the mortgagee at the scheduled time and place of sale.
Other terms, if any, to be announced at the sale. The successful bidder shall be required to sign a Memorandum of Terms and Conditions containing the above terms at the sale.
If the highest bidder fails to complete the purchase of the premises on the terms provided in this notice and in the Memorandum of Terms and Conditions signed following the sale, the Mortgagee reserves the right to sell the premises to the second highest bidder (or each subsequent highest bidder thereafter) who will then have five (5) days to deliver the deposit specified above to the Mortgagee's attorney as herein indicated, and to agree to a closing date for payment of the remaining balance of such subsequent highest bid and transfer of deed that is within thirty (30) days thereafter.
