NOTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE that the Planning Board of the Borough of Raritan, Somerset County, New Jersey (the "Planning Board"), will hold a public hearing on December 3, 2025, at 6:30 PM in the Courtroom of the Municipal Building located at 22 First Street, Raritan, N.J. 08869, to investigate and determine whether all, or a portion, of the area hereinafter described meets the criteria for an area in need of redevelopment pursuant to N.J.S.A. 40A:12A-5 and should be designated as such a non-condemnation area in need of redevelopment.
Said area is approximately 1.6 acres consisting of the property identified on the Tax Map of the Borough of Raritan, State of New Jersey as Block 116.01, Lot 26 with frontage along Busky Lane (the "Study Area").
This public hearing is being held pursuant to the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq. as amended (the "Redevelopment Law"), which authorizes municipal governing bodies to designate certain areas of the municipality as a non-condemnation area in need of redevelopment, which designation would permit the Borough to utilize all of the redevelopment powers afforded to it by statute, excluding Eminent Domain (as designated, a "non-Condemnation Redevelopment Area"); and
PLEASE TAKE FURTHER NOTICE that you are entitled to be present at said public hearing to present any and all objections, or support, you may have, and any other general comments, relative to the Planning Board's investigation as to whether all, or a portion of, the Study Area should be designated as a non-Condemnation Redevelopment Area. The Resolution of the Municipal Council authorizing and directing the Planning Board to undertake this preliminary investigation and make recommendations to the Borough Council (Resolution No. 2025-09-133), the Redevelopment Area investigation report prepared by Joseph Brosnan, PE, PP, of Van Cleef Engineering, and a map depicting the boundaries of the proposed Redevelopment Area, along with a statement setting forth the basis for the investigation, are on file with the Borough Clerk and the Planning Board Clerk at the Municipal Building, 22 First Street, Raritan, N.J. 08869, and all are available for inspection during regular business hours.
PLEASE TAKE FURTHER NOTICE that, after review by the Planning Board at the hearing described herein and a recommendation is made to the Borough Council, as well as a finding by the Borough Council that the Study Area, or a portion thereof, constitutes a non-Condemnation Redevelopment Area, these findings shall operate as a finding of public purpose but shall not authorize the Borough to use the power of Eminent Domain.
PLEASE TAKE FURTHER NOTICE that, if the Borough Council designates all, or a portion, of the Study Area as a non-Condemnation Redevelopment Area, owners of the designated property will receive a notice from the Borough notifying them of the designation and will have forty-five (45) days from the receipt of such notice to challenge the redevelopment designation by filing the appropriate action in the Superior Court of New Jersey, Law Division.
