NOTICE OF FORECLOSURE SALE
ETOWAH COUNTY, ALABAMA
Default having been made in the payment of the indebtedness secured by that certain mortgage given by Madison Drake, Single Woman to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for FirstBank, dated September 12, 2022, and recorded at Instrument # 3546603 on September 14, 2022, in the Office of the Judge of Probate of Etowah County, Alabama, as last transferred to Alabama Housing Finance Authority by assignment, recorded on October 16, 2025, in Book 2025, at Page 3599325 in the Office of the Judge of Probate of Etowah County, Alabama, conveying the after-described property to secure a Note in the original principal amount of One Hundred Thousand One Hundred Fifty-Two and 0/100 dollars ($100,152.00), with interest thereon as set forth therein. Brock and Scott, PLLC, as counsel for Mortgagee or Transferee and under and by virtue of power of sale contained in the said mortgage will, on January 21, 2026, sell at public outcry to the highest bidder for cash at the main courthouse entrance of Etowah County, Alabama, within the legal hours of sale, the following described property:
To reach a point of beginning for the hereinafter described parcel of land, commence at the Northeast corner of Lot #81; thence run North 88 degrees 00 minutes West. along the North line thereof, 59.04 feet to a point, which is the point of beginning of the parcel of land herein described; thence from said point of beginning, run South 00 degrees 20 minutes East, 141.54 feet to a point in the North line of the parcel of land described in deed record 912, page 229, Probate Office, Etowah County Alabama; thence run North 85 degrees 01 minutes West, along said North line, 68.08 feet to a point in the East line of the parcel of land described in deed record 866, page 33, said Probate Office; thence run North 05 degrees 28 minutes East, along said East line, 138.06 feet to a point in aforementioned North line of Lot #81; thence run South
88 degrees 00 minutes East, along said North line, 53.78 feet to the point of beginning, and embracing portions of Lots #60, 61 and 81 in Block #6, of Westview Addition. as recorded in plat book "A", page #1, said Probate Office, and lying and being in Gadsden, Etowah County, Alabama.
The debt secured by said Mortgage has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Mortgage. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Mortgage and by law, including attorney’s fees.
This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the Office of the Judge of Probate of the County where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.

To the best knowledge and belief of the undersigned, the party in possession of the property is Madison Drake or tenant(s); and said property is more commonly known as 942 Cleveland Ave, Gadsden, AL 35901.
The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code (2) final confirmation and audit of the status of the loan with the holder of the mortgage and (3) any right of redemption or other lien not extinguished by foreclosure.
