MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Ronald B. Brinck and John R. Brinck to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for IndyMac Bank, F.S.B., its successors and assigns, dated October 4, 2005 and recorded in Worcester County (Worcester District) Registry of Deeds in Book 37527, Page 233 (the “Mortgage”), as affected by a Loan Modification Agreement dated July 3, 2018, and recorded at said Registry of Deeds in Book 59172, Page 266 of which mortgage Lehman XS Trust Mortgage Pass-Through Certificates, Series 2005-7N, U.S. Bank National Association, as Trustee is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc. as nominee for IndyMac Bank, F.S.B., a Federally Chartered Savings Bank its successors and assigns to Lehman XS Trust Mortgage Pass-Through Certificates, Series 2005-7N, U.S. Bank National Association, as Trustee dated September 4, 2015 and recorded at said Registry of Deeds in Book 54291, Page 327, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 3 Pitcairn Avenue, Leicester, MA 01524 will be sold at a Public Auction at 2:00 PM on December 12, 2025, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
The land in Leicester, County of Worcester, State of Massachusetts, with all the buildings and improvements thereon, is bounded and described as follows: Being Lot #11 as shown on Plan of Land of Peter Salem Village, Leicester, Mass. Owned by Riedi Associates, Inc., drawn by Frank Conery, Registered Engineer & Land Surveyor, April, 1955, filed with Worcester County Registry of Deeds and more completely described as follows:
Beginning at a point in the easterly line of Pitcairn Avenue, said point being S. 17 deg. 49' E., one hundred fifty-five and 34/100 (155.34) feet from a cement bound;
Thence by Lot #10B, N. 72 deg. 11' E., two hundred ninety (290) feet to point;
Thence S. 05 deg. 15' W., ninety-two and 38/100 (92.38) feet to Lot #12;
Thence by Lot #12, S. 72 deg. 11' W., two hundred fifty-three and 8/10 (253.8) to a point in the easterly line of Pitcairn Avenue;
Thence by Pitcairn Avenue, N. 17 deg. 49' W., eighty-five (85) feet to the point of beginning.
Containing 24,000 square feet, more or less.
For mortgagor’s title see deed recorded with the Worcester County (Worcester District) Registry of Deeds in Book 37527, Page 231.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
