Premises: 105 Acorn Street, Marshfield, MA 02050
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Richard R. Perilli and Karen J. Perilli to Salem Five Mortgage Corporation, dated January 31, 1995, and recorded with the Plymouth County Registry of Deeds in Book 13402, Page 324 of which mortgage the undersigned is the present holder by assignment, by an assignment of mortgage from Salem Five Mortgage Corporation to Salem Five Cents Savings Bank, dated January 31, 1995, and recorded with said Registry in Book 13402, Page 336, and by an assignment of mortgage from Salem Five Cents Savings Bank to The Hibernia Savings Bank, dated February 24, 1995, and recorded with said Registry in Book 13520, Page 181, and by an assignment of mortgage from Eastern Bank, as successor by merger to The Hibernia Savings Bank to ABN AMRO Mortgage Group, Inc., dated June 1, 2006, and recorded with said Registry in Book 34066, Page 51, and by an assignment of mortgage from Citimortgge, Inc., successor by merger to ABN AMRO Mortgage Group, Inc., to Green Tree Servicing, LLC, dated June 5, 2014, and recorded with said Registry in Book 44392, Page 132, and by an assignment of mortgage from Ditech Financial, LLC f/k/a Green Tree Servicing, LLC to U.S. Bank Trust, N.A., as Trustee for LSF10 Master Participation Trust, dated October 5, 2018, and recorded with said Registry in Book 50445, Page 193, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold by Public Auction at 10:00 o’clock A.M. on the 17th day of December, 2025 at the mortgaged premises located at 105 Acorn Street, Marshfield, MA 02050, Plymouth County, Massachusetts, all and singular the premises described in said mortgage, To wit:The land in Marshfield, Plymouth County, Massachusetts, with the buildings thereon, located on the Southwesterly side of Acorn Street, and bounded and described as follows: Beginning at an iron pipe on the Southeasterly side of said Acorn Street, it also being the corner of land supposed to belong to Agnes Cann; thence by her land and land formerly owned by the Plymouth Co-operative Bank, the five following courses and distances: SOUTH 83 deg 13’ East 86.70 feet to an iron pipe; SOUTH 83 deg. 54’ 30’ East 19.97 feet; SOUTH 82 deg. 53’ 50” East 97.53 feet; SOUTH 82 deg. 06’ 20’ East 192.45 feet; and SOUTH 82 deg. 54’ 10” East about 366.76 feet to Moraine Street; Thence by said Moraine Street South 17 deg. 58’ 30” 75.44 feet to land now or formerly owned by W.A. Bradford; Thence by said Bradford land South 78 deg. 49’ 30” West 412.73 feet; Thence by land of the Marshfield County Club North 80 deg. 47’ 10” feet; Thence by land formerly owned by W.F. White North 80 deg. 52’ 50’ West about 223.34 feet to said Acorn Street; Thence by said Acorn Street North 50 deg. 57; 30” East 239.66 feet to the point of beginning. The above described premises contained about 3.20 acres. Excepting, however, from the above described premises so much thereof as was conveyed by Alexander H. Rutledge to Agnes F. Reed by Deed dated February 18, 1949, and record with said Registry, Book 2012 Page 255, bounded and described as follows: The land in said Marshfield, located on the Westerly side of Moraine Street, and bounded: Beginning at a point in the wall at land now or formerly owned by the Plymouth Co-operative Bank in the Northerly side of the hereinafter conveyed premises; Thence by the wall by their land South 83 deg. 54’ 10” East 350 Feet to said Moraine Street. Thence by said Bradford’s land South 78 deg. 49’ 30” West 350 feet to land now or formerly owned by A.H. Rutledge; Thence by said A.H. Rutledge’s land North 8 deg. 59’ West 178.93 feet to the point of beginning. Said premises contained about 43,347 square feet of land and are shown on a plan entitled “Plan of Land at Moraine Street, Marshfield, MA, conveyed by Alexander H. Rutledge to Agnes F. Reed, “Scale 50’ = 1”, February 25, 1949, W.G. For, C.E., Marshfield, MA, recorded with said Registry of Deeds, Plan Book 8, Page 41. Being the same premises conveyed to us by deed January 31, 1995 recorded herewith. Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. TERMS OF SALE: A deposit of Ten Thousand Dollars ($10,000.00) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. High bidder to sign written memorandum of sale upon acceptance of the high bid.
