NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Wayne J. Iodice, Jane C. Iodice to Mortgage Electronic Registration Systems, Inc., as nominee for Washington Trust Mortgage Company LLC, dated January 21, 2022 and recorded in the Bristol County (Northern District) Registry of Deeds in Book 27678, Page 189, of which mortgage the undersigned is the present holder, by assignment from:
Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Washington Trust Mortgage Company LLC, its successors and assigns to U.S. Bank National Association, recorded on August 28, 2023, in Book No. 28545, at Page 321
U.S. Bank National Association to Select Portfolio Servicing, Inc., recorded on March 4, 2024, in Book No. 28768, at Page 190
for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 10:00 AM on December 22, 2025, on the mortgaged premises located at 9 Tori Leigh Lane, Rehoboth, Bristol County, Massachusetts, all and singular the premises described in said mortgage,
TO WIT:
The land in Rehoboth, Bristol County and Commonwealth of Massachusetts, with all the buildings and other improvements thereon, situated at northeasterly corner of Tori Leigh Lane and Roberts Road, laid out and designated as Lot 11 (eleven) that certain plan entitled "Definitive Subdivision North Woods Belonging to Sagar's Services, Inc. Rehoboth, Massachusetts Caputo and Wick Ltd. 1150 Pawtucket Avenue Rumford, RI 02916 Date March 10, 2000", and recorded with the Bristol County Northern District Registry of Deeds in Plan Book 389, Pages 2 to 23. Said Lot 11 contains 69,632 square feet of land according to said plan.
Said premises are conveyed subject to and together with the right to use Tori Leigh Lane and Roberts Road as shown on said recorded plan in Plan Book 389 at Pages 2 to 23, with all others entitled thereto, for all purposes for which streets, lanes, ways and roads are commonly used in the Town of Rehoboth.
This conveyance is subject to twenty-five (25') foot building setback lines, and thirty (30') foot building setback lines as shown on said recorded plan in Plan Book 389 at Pages 2 to 23, Fire Protection Tank Easement F-2 as shown on said recorded plan in Plan Book 389 at Pages 2 to 23, North Woods Declaration of Covenants and Restrictions recorded in Book 8935 at Page 231, Order of Conditions in DEP 60-517 recorded in Book 8845 at Page 88, Agreement with the Town of Rehoboth, dated July 26, 2000, and recorded in Book 8905 at Page 94, and Utility Easement of Sagar's Services, Inc. to Massachusetts Electric Company, dated November 7, 2000, and recorded in Book 9124 at Page 178.

These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE:
A deposit of Fifteen Thousand ($15,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Harmon Law Offices, P.C., 150 California St., Newton, Massachusetts 02458, or by mail to P.O. Box 610389, Newton Highlands, Massachusetts 02461-0389, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. The description of the premises contained in said mortgage shall control in the event of an error in this publication.
