TRUSTEE'S NOTICE OF SALE, NOTICE OF DEFAULT AND ELECTION TO SELL
The Successor Trustee, under the terms of the Trust Deed described herein, at the direction of the Beneficiary, hereby gives notice of sale, default, and elects to sell the property described in the Trust Deed to satisfy the obligations secured thereby. Pursuant to ORS Chapter 86, the following information is provided:

DESCRIPTION OF PROPERTY: The real property is described as follows:
Parcel 2, of LAND PARTITION PLAT NO. 2008-P2204, Recorded January 23, 2008, Reception No. 2008-004159, Official Records of Lane County, Oregon.
Otherwise known as: 1257 Ellsworth Street, Eugene, Lane County, Oregon 97402
RECORDING: The Trust Deed was recorded as follows: dated April 7, 2023, Recorded: April 11, 2023, as reception No. 2023-009350 of the Records of Lane County, Oregon.
DEFAULT: The Grantor is in default and the Beneficiary has declared all sums due pursuant to the terms of that promissory note dated April 11, 2023, in the original amount of $150,000.00 plus interest thereon at the rate of 12% per annum from May 11, 2023, in monthly principal and interest installments of $1,500.00, until April 11, 2025, when the entire unpaid principal balance plus accrued interest is due and payable, and late fee at 5% after 15 days monthly payments are late, the original of which is incorporated into the said trust deed by reference, the entire balance of which is presently due and owing, and has elected to foreclose the Trust Deed because of the following: (1) failure to pay $150,000.00 in principal payments; (2) failing to pay $7,850.85 in interest (through November 19, 2025); and (3) failure to pay late fees through November 2025, in the sum of $150.00, for a total sum of $158,000.85.
AMOUNT DUE: By reason of the default just described, the Beneficiary has declared and does hereby declare all sums owing on the obligations secured by the trust deed immediately due and payable, those sums being the following, to-wit: principal amount in the sum of $150,000.00, interest in the sum of $7,850.56, plus interest at a rate of 12% per annum until fully paid, delinquent late fees in the sum of $150.00, for a total sum of $158,000.85, plus title expenses, insurance, costs, trustee fees, attorney fees and any other cost advances made by Beneficiaries to protect their interest in the said real property pursuant to the terms of the said trust deed, including but not limited to attorney fees and costs incurred in defending and protecting Beneficiary's interest in the said real property against claims by third parties.
ELECTION TO SELL: The Successor Trustee hereby elects to sell the property to satisfy the obligations secured by the Trust Deed.

RIGHT TO REINSTATE: The right exists under ORS 86.778 to have the proceeding dismissed and the trust deed reinstated by paying the entire amount then due, together with costs, trustee's fees and attorney fees, and by curing any other default complained of in the notice of default, at any time this is not later than five days before the date last set for the sale.
