NOTICE OF SALE GEORGIA, CHATHAM COUNTY. By virtue of a power of sale contained in that certain Security Deed from ONE GATEWAY BLVD., LLC to Colony Bank, successor by corporate merger to COLONY ("Colony"), dated January 10, 2020, and recorded in Deed Book 1822, Page 76, et seq., in the Office of the Clerk of Superior Court of Chatham County, Georgia (the "Security Deed"), said Security Deed having originally been given to secure that certain Promissory Note dated January 10, 2020 in the original principal amount of TWO MILLION NINE HUNDRED THIRTY-FIVE THOUSAND AND 00/100 DOLLARS ($2,935,000.00) of even date therewith, as well as all extensions, renewals and modifications thereof, together with any and all other indebtedness, of any type or description, then or thereafter owing by ONE GATEWAY BLVD., LLC to COLONY here will be sold by the undersigned, at public outcry, to the highest bidder for cash, before the courthouse door at Savannah, Chatham County, Georgia, within the legal hours of sale on the first Tuesday in January, 2026, the following described property: All those certain lots, tracts or parcels of land situated, lying and being in the Seventh G.M. District of Chatham County, Georgia, being known as Tract Two and Tract Three, Gateway Savannah Subdivision Phase No. 1 and the adjacent 1.22 acres in the Northeast Quadrant of Interstate Highway 95 and Abercorn Street Extension, said Tract Two and Tract Three and the adjacent 1.22 acres containing, in the aggregate, 6.40 acres, formerly a portion of Union Camp Corporation's Southern States No. 5 Tract, and being mote particularly described as follows: THE POINT OF BEGINNING IS APPROACHED AS FOLLOWS: COMMENCE AT Station No. .839+00 located at the intersection of the centerline of Gateway Boulevard (100 ft. right-of-way) and the centerline of Abercorn Street Extension; run thence North 14°51'30" East as measured along the centerline of Gateway Boulevard 180.00 ft. to a point: run thence North 75°08'30" West 50.00 ft. to a point located on the Northwestern right-of-way of Gateway Boulevard (100 ft. right-of-way); run thence in a Northeasterly direction as measured along the arc of the Northwestern right-of-way of Gateway Boulevard 244.43 ft. to a concrete monument being Station No. 2+44.43 located on the Western right-of-way of Gateway Boulevard and being the POINT OF BEGINNING; from said POINT OF BEGINNING, running thence North 16°40'08" West 106.83 ft. to a concrete monument; running thence North 63°29'08" West 122.27 ft. to an iron rod; continuing thence North 63°29'08" West 45.09 ft. to a concrete monument located on the Eastern right-of-way line of Interstate Highway 95; running thence North 24°33'52" East as measured along the Eastern right-of-way line of Interstate Highway 95 348.12 ft. to an iron pin; continuing thence North 30°27'12" East as measured along the Eastern right-of-way line of Interstate 95 218.95 ft. to a point; continuing thence along said Eastern right-of-way line of Interstate Highway 95, and along the arc of a curve having a chord measurement of 269.95 ft. along a bearing of North 36°03' East to a concrete monument; running thence South 42°05'33'' East 103.08 ft. to an iron pin; continuing thence South 42°05'33" East 408.23 ft. to a concrete monument, being Station No. 10+34.22 of Gateway Boulevard located on the Northwestern right-of-way; running thence South 59°46'42" West as measured along the Western right-of-way of Gateway Boulevard 200.02 ft. to a point, continuing thence in a Southwesterly direction as measured along the arc of the north-western right-of-way of Gateway Boulevard 589.97 ft. to a concrete monument being Station No. 2+44.43 of Gateway Boulevard and being the POINT OF BEGINNING. Said tracts of land are shown as Tract Two and Tract Three and the 1.22 acre portions of the Landscaping Drainage and Open Space Easement area West of Tracts Two and Three, and lying between the Northern boundary line of Tract Three and the Southern boundary line of Tract Two as said boundary lines are extended Westwardly to the Eastern right-of-way line of Interstate Highway 95, and are more fully described and delineated upon a boundary map of a transit survey of said lands made and prepared under the direction of and certified by William G. Foster, Georgia Registered Surveyor No. 1364, Thomas & Hutton Engineering Company, under dated of July 26, 1977, entitled "Revised Plat, Gateway Savannah, Phase No. 1, Chatham County, Georgia", a copy of which map is filed in Subdivision Map Book O, Folio 34, in the Office of the Clerk of the Superior Court of Chatham County, Georgia, said recorded plat is by reference incorporated into this legal description, and reference is hereby made to said survey for a more complete description of the property. The property is also shown on a "Plat of Tracts Two and Three, Gateway Savannah Subdivision, Phase 1 and the Adjacent 1.22 acres in the Northeast Quadrant of Interstate 95 and Abercorn Street Extensions", made and prepared under the direction of, and certified by, Roy Hussey, Georgia Registered Surveyor No. 1212, Hussey, Gay & Bell, Consulting Engineers, under date of August 29, 1973, revised January 8, 1979, a copy of which is filed in Subdivision Map Book CC, Folio 186, in the Office of the Clerk of Superior Court of Chatham County, Georgia, as last revised June 5, 1987, said recorded plat, as updated, is by reference incorporated herein and reference is hereby made to said survey for a more complete description of the property. Further reference is also made, for a more complete description of said property, to that Plat of Tracts 2 and 3, Gateway Subdivision, Phase 1, prepared for First Florence Corporation, Inc., Southern National Bank of South Carolina and Chicago Title Insurance Company, revised and updated on July 28, 1993 by James M. Sims, GA Reg. L.S. #2280, Hussey, Gay & Bell, which Map or Plat is recorded at Plat Book 12P, Page 178 in the records of Chatham County, Georgia. Further reference is also made to that certain plat of survey dated April 18, 2014, prepared for Double S Hotel Ventures, LLC, Spillman Short, Peoples State Bank & Trust and First American Title Insurance Company by Michael S. Williams, Land Surveyor No. 2712, and recorded in the Office of the Clerk of the Superior Court of Chatham County, Georgia on July 7, 2014 in Plat Book 48P, Page 166. This property is more commonly known as 1 Gateway Blvd., Savannah, GA 31419; Consisting of the following Parcel Identification No. 1-1028-01-017. Also to be sold by the undersigned at such sale shall be certain personal property collateral pledged to COLONY by ONE GATEWAY BLVD., LLC pursuant to the terms of the Security Deed described above and that certain Security Agreement, dated January 10, 2020, such personal property collateral being more particularly described as follows: All inventory, equipment, accounts (including but not limited to all health-care-insurance receivables), chattel paper, instruments (including but not limited to all promissory notes), letter-of-credit rights, letters of credit, documents, deposit accounts, investment property, money, other rights to payment and performance, and general intangibles (including but not limited to all software and all payment intangibles); all oil, gas and other minerals before extraction; all oil, gas, other minerals and accounts constituting as-extracted collateral; all fixtures; all timber to be cut; all attachments, accessions, accessories, fittings, increases, tools, parts, repairs, supplies, and commingled goods relating to the foregoing property, and all additions, replacements of and substitutions for all or any part of the foregoing property; all insurance refunds relating to the foregoing property; all goodwill relating to the foregoing property; all records and data and embedded software relating to the foregoing property, and all equipment, inventory and software to utilize, create, maintain and process any such records and data on electronic media; and all supporting obligations relating to the foregoing property; all whether now existing or hereafter arising, whether now owned or hereafter acquired or whether now or hereafter subject to any rights in the foregoing property; and all products and proceeds (including but not limited to all insurance payments) of or relating to the foregoing property. The security interest granted in the foregoing personal property, as set forth in the Deed to Secure Debt and Security Agreement described above and that certain Security Agreement described above, has been perfected by virtue of certain UCC Financing Statement recorded in the central indexing system of the State of Georgia. Notice of Sale of these items of personal property which, in part, may be fixtures attached to and used in connection with the above-described real property is provided in accordance with the provisions of the Official Code of Georgia Annotated, Section 11-9-601, et seq. The indebtedness secured by the aforementioned Security Deed has been and is hereby declared immediately due and payable in full because of the failure of ONE GATEWAY BLVD., LLC to maintain payments upon said indebtedness owing to COLONY in accordance with its terms. Said indebtedness remaining in default, this sale shall be made for the purpose of paying such indebtedness, as well as all expenses of this sale, including attorneys' fees. The above-described property will be sold as the property of ONE GATEWAY BLVD., LLC and will be sold subject to the following items which may affect the title to said property: all zoning and subdivision ordinances and/or regulations; matters which would be disclosed by an accurate survey or an inspection of the property; all real property ad valorem taxes or assessments, which may constitute liens upon said property; all liens which, under applicable law, would take priority over the Security Deed described above; and all easements, restrictions, rights-of-way, security deeds or other encumbrances of record which have priority over the referenced Security Deed.
