SUBSTITUTE TRUSTEE'S NOTICE OF FORECLOSURE SALE
WHEREAS on November 17, 2005, Charles Knight, an unmarried man, executed a Deed of Trust to Arnold M. Weiss, as Trustee, and Mortgage Electronic Registration System, Inc., solely as nominee for Homecomings Financial Network Inc., its successors and assigns, as Beneficiary, which Deed of Trust is on file and of record in the Office of the Chancery Clerk of Madison County, Mississippi, in Deed of Trust Record in Book 1989, Page 136 and as Instrument Number 488229; and
WHEREAS, Mortgage Electronic Registration System, Inc., solely as nominee for Homecomings Financial Network Inc. assigned said Deed of Trust to Federal National Mortgage Association via an instrument dated November 10, 2023 and recorded in Book T-4386, Page 576 - and as Instrument Number 994666 - in the Office of the Chancery Clerk of Madison County, Mississippi; and
WHEREAS, Federal National Mortgage Association assigned said Deed of Trust to NewRez LLC d/b/a Shellpoint Mortgage Servicing, recorded in Book T-4481, Page 457.- and as Instrument No. 1011399 in the Office of the Chancery Clerk of Madison County, Mississippi; and
WHEREAS, NewRez LLC d/b/a Shellpoint Mortgage Servicing appointed Dean Morris, LLC as Substitute Trustee in place of the afore-mentioned original Trustee via an instrument recorded in Book 4485, Page 49 – and as Instrument No. 1012004 - in the Office of the Chancery Clerk of Madison County at Canton, Mississippi above; and
WHEREAS, NewRez LLC d/b/a Shellpoint Mortgage Servicing appointed McCalla Raymer Leibert Pierce, LLP as Substitute Trustee in place of the afore-mentioned original Trustee and substituted Trustee via an instrument recorded in Book 4535, Page 690 – and as Instrument No. 1023911 - in the Office of the Chancery Clerk of Madison County at Canton, Mississippi above; and
WHEREAS, NewRez LLC d/b/a Shellpoint Mortgage Servicing appointed Padgett Law Group as Trustee in place of the afore-mentioned original Trustee and substituted Trustees via an instrument dated October 8, 2025 and recorded in Book 4606, Page 221 – and as Instrument No. 1036608 – in the Office of the Chancery Clerk of Madison County, Mississippi; and
WHEREAS, default has occurred in the payment of the indebtedness secured by said deed(s) of trust, and NewRez LLC d/b/a Shellpoint Mortgage Servicing, as beneficiary, has authorized and instructed Padgett Law Group as substitute trustee to foreclose said deed(s) of trust by advertisement and sale at public auction in accordance with the statutes made and provided therefor.
THEREFORE, notice is hereby given that pursuant to the power of sale contained in said deed(s) of trust and in accordance with the statutes made and provided therefor, the said deed(s) of trust will be foreclosed and the property covered thereby and hereinafter described will be sold at public auction to the highest bidder for cash at the South front door of the new Madison County Courthouse, at 128 West North Street in Canton, Mississippi, and will sell within legal hours (being between the hours of 11:00 AM and 4:00 PM) on January 8, 2026, to satisfy the indebtedness now due under and secured by said deed(s) of trust.
Padgett Law Group will convey only such title as vested in it as Substituted Trustee. The premises to be sold are described as:
Lot 134, Sherbourne Subdivision, Part 5, a subdivision according to the map or plat thereof on file and of record in the Office of the Chancery Clerk of Madison County at Canton, Mississippi as now recorded in Plat Cabinet D at Slide 156, reference to which is hereby made in aid of and as a part of this description.
The successful bidder must tender full funds at the conclusion of the sale in the form of a certified check made payable or endorsed to Padgett Law Group. No personal checks will be accepted. To this end you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted.
Amounts received in excess of the winning bid will be refunded. Padgett Law Group reserves the right to award the bid to the next highest bidders should the highest bidder fail to timely tender the total amount due.
