PUBLIC HEARING NOTICE
Ref #1648H – Modification #2
In accordance with the provisions of Mass. General Law, Chapter 41, Sections 81T and 81U, the Yarmouth Planning Board will hold a Public Hearing on Wednesday, January 7, 2026 at 5:30 P.M. in the Hearing Room of the Yarmouth Town Offices, 1146 Route 28, South Yarmouth, MA 02664, and via remote access at https://us02web.zoom.us/J/89836415124 or via telephone at (301) 715 8592 and entering webinar ID 898 3641 5124, to consider the following:
1. Definitive Subdivision #1648H, Modification #2: Owners/Applicants: Brian D. Basler, Trustee of the Brian D. Basler Living Trust and Marcy L. Basler, Trustee of the Marcy L. Basler Living Trust, 46 Minnetuxet Way, Yarmouth Port, MA. Property Location: 63 Thacher Shore Road, Yarmouth Port, MA; Assessor’s Map 122, Parcel 24.1; Zoning District R40 Residential. The applicant is seeking approval for modifications to the previously approved Definitive Subdivision #1648H, and #1648H Modification #1. The requested modifications include increasing the maximum centerline grade; reducing the roadway cross slope; eliminating the drainage swales in favor of vegetated shoulders; and allowing for a drill hole set in a rock to serve as a boundary monument. The proposed modifications are shown on the plans entitled, “Definitive Subdivision Plan of Land in Yarmouth Port, MA Prepared for Brian Sullivan Realty Trust”, dated May 5, 2017 and last revised on October 3, 2025; and “Roadway As-Built Plan of 63 Thacher Shore Road Yarmouth Port, MA, prepared for Brian Basler”, dated October 15, 2024 and last revised on June 30, 2025. All plans prepared by Daniel A. Ojala, PE/PLS of Down Cape Engineering Inc. of Yarmouth Port, MA. The requested modifications do not change the roadway layout or the dimensions of the single lot created by the original subdivision plan #1648H.
Copies of the plans and application materials are on file with the Planning Board and may be inspected Monday through Friday, between the hours of 8:30 a.m. and 4:30 p.m. in the Planning Division office at the Yarmouth Town Offices, and on the Town of Yarmouth website.
