NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Edward W. Geran, Jr. to New England Capitol Mortgage Corporation, dated August 7, 2003 and recorded in the Norfolk County Registry of Deeds in Book 19599, Page 38, of which mortgage the undersigned is the present holder, by assignment from:
New England Capitol Mortgage Corporation to GMAC Bank, recorded on August 12, 2003, in Book No. 19599, at Page 53
GMAC Bank to NewRez LLC d/b/a Shellpoint Mortgage Servicing, recorded on March 24, 2025, in Book No. 42305, at Page 241
for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 2:00 PM on January 21, 2026, on the mortgaged premises located at 30 Church Street, Unit 30-3, Church Elms Condominium, Braintree, Norfolk County, Massachusetts, all and singular the premises described in said mortgage,
TO WIT:
All that certain premises and proportionate interest in and to the Church Elms Condominium, a Condominium in Braintree, Norfolk County, Massachusetts, more particularly described as follows:
The Unit known as No. 30-3 in the Church Elms Condominium ("the Condominium") located in the building known and numbered 30 Church Street, Braintree, Massachusetts ("the Building"), a condominium established pursuant to Chapter 183A of the Massachusetts General Laws (the "Condominium Law") by Master Deed ("Master Deed dated December 2, 1985 and recorded with the Norfolk Registry of Deeds in Book 6875, Page 37, as may be amended of record, which unit is shown on the Floor Plans ("Plans") of the Building recorded simultaneously with said Master Deed or Amendment of Master Deed, to which is affixed the verified statement of a registered professional engineer, architect or land surveyor in the form required by Section 9 of said Chapter 183A.
Said Unit is conveyed together with a 2.00% interest in the common areas and facilities (the "Common Elements") of the Condominium described in the Master Deed, attributable to the Unit and the exclusive right to use any patio or balcony adjacent to such Unit and to which there is direct access from the interior of such unit.
The Unit is conveyed with the benefit of and subject to:
(a) the rights, covenants, easements and agreements contained in the Master Deed, the Condominium Trust and By-Laws, as any of the same may be amended from time to time pursuant to the provisions thereof, and the Unit deed recorded in Book 7598, Page 289
(b) The provisions of the Condominium Law, Massachusetts General Law, Chapter 183A.
For mortgagor's(s') title see deed recorded with Norfolk County Registry of Deeds in Book 10978, Page 296.
These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE:
A deposit of Ten Thousand ($10,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Harmon Law Offices, P.C., 150 California St., Newton, Massachusetts 02458, or by mail to P.O. Box 610389, Newton Highlands, Massachusetts 02461-0389, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. The description of the premises contained in said mortgage shall control in the event of an error in this publication.
