RESOLUTION NO. 4622
A RESOLUTION OF THE COMMON COUNCIL OF THE TOWN OF GILBERT, ARIZONA, AMENDING THE “2024 LAND USE ASSUMPTIONS INFRASTRUCTURE IMPROVEMENT PLAN AND SYSTEM DEVELOPMENT FEE STUDY” DATED APRIL 16, 2024, PREPARED BY LRB PUBLIC FINANCE ADVISORS, BY SUBSTITUTING CONSTRUCTION OF A NEW TRAFFIC SIGNAL AT LAYTON LAKES AND LINDSAY INSTEAD OF CHESTNUT AND VAL VISTA.
WHEREAS, the Town retained LRB Public Finance Advisors, fiscal, economic, and planning consultants, to prepare a written report analyzing the adopted Land Use Assumptions and the Infrastructure Improvements Plan and recommending system development fees for necessary public services, including traffic signal facilities, to offset burdens imposed by new development on the Town, and
WHEREAS, on January 23, 2024, the Town of Gilbert adopted the written report prepared by LRB Public Finance Advisors as the Town’s Land Use Assumptions and an Infrastructure Improvements Plan (“IIP”) as required by Arizona Revised Statutes Section 9-463.05 prior to adopting its system development fees in 2024; and
WHEREAS, on April 16, 2024, the Town Council adopted system development fees in accordance with the requirements of Arizona Revised Statutes Section 9-463.05, which fees became effective on July 1, 2024; and
WHEREAS, Table 6.6 of the IIP anticipated that the Town would use system development fees to construct a new traffic signal (TS1968) at the location of Chestnut and Val Vista; and
WHEREAS, the Town has determined that it is in its best interest to identify different sites for the traffic signals at Chestnut and Val Vista (TS1968); and
WHEREAS, system development fees currently in effect will not be changed as a result of the substitution of this traffic signal; and
WHEREAS, the level of service in the service area will not be increased by the amendment.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL that the IIP is hereby amended by substituting the traffic signal project on Table 6.6 from TS1968 Chestnut and Val Vista Signal to TS1986 Layton Lakes and Lindsay in compliance with the requirements of Arizona Revised Statutes Section 9-463.05.
FURTHER RESOLVED, that the Town Clerk is hereby directed to provide notice of the amendment and post the amendment on the Town’s website.
