NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
Premises: 1814 Pleasant Street, Fall River, MA 02723
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Gerald F Bennett to Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for BBMC Mortgage A Division of Bridgeview Bank Group, and now held by NewRez LLC d/b/a Shellpoint Mortgage Servicing, said mortgage dated October 19, 2018 and recorded in the Bristol County (Fall River District) Registry of Deeds in Book 9631, Page 314, said mortgage was assigned from Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for BBMC Mortgage A Division of Bridgeview Bank Group to NewRez LLC d/b/a Shellpoint Mortgage Servicing by assignment dated August 5, 2024 and recorded with said Registry of Deeds in Book 11579, Page 137; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on January 22, 2026 at 12:00 PM Local Time upon the premises, all and singular the premises described in said mortgage, to wit:
The land with the buildings thereon, situated in Fall River, in said County and Commonwealth, bounded and described as follows:
Beginning at the southwesterly corner of the land to be described at a point on the northeasterly side of Pleasant Street marked by a drill hole ninety and 75/100 (90.75) feet southeasterly from the northeasterly corner of Pleasant Street and Bogle Street; thence running northerly by land now or formerly of Rudolphe T. Letendre et ux, seventeen and 23/100 (17.23) feet to a drill hole in a sidewalk; thence running northeasterly by last named land fourteen and 75/100 (14.75) feet to a drill hole in a sidewalk; thence continuing northeasterly by last named land twenty-two and 58/100 (22.58) feet to a stake and other land of said Rudolphe T. Letendre et ux, thence running easterly by last named land twelve and 10/100 (12.10) feet to a stake for a corner; thence running again northerly by last named land forty-six and 83/100 (46.83) feet to a stake for a corner; thence running again easterly by last named land thirty-eight and 58/100 (38.58) feet to a stake for a corner; thence running southerly by land of owners unknown one hundred eighty and 45/100 (180.45) feet to said Pleasant Street; thence running northwesterly by said Pleasant Street one hundred six and 50/100 (106.50) feet to the point of beginning; containing twenty- eight and 823/1000 (28.823) square rods, more or less.
Together with the right to pass and repass for all purposes and in any usual and customary manner over and upon a strip of land adjoining said premises on the west and shown and described on a certain plan hereinafter referred to as a "Three Foot Way"; and also to make any reasonable use of said strip for the maintenance and repair of buildings on said premises.
The premises hereby conveyed and the "Three Foot Way" above referred to are shown on Plan of Land Surveyed for Rudolphe T. Letendre located in Fall River, Massachusetts Leo W. Grantor, Reg, L.S. August 19, 1946, recorded in Fall River District Registry of Deeds and being Plan No. 1306.
The improvements thereon being commonly known as 1814 Pleasant Street, Fall River, MA 02723.
Being the same lot or parcel of ground which by Deed dated October 10, 1978 and recorded October 10, 1978 among the Land Records of Bristol County, State of Massachusetts, in Book: 1244, Page: 223 was granted and conveyed/assigned by and between Rudolph W Terry & Marguerite L Terry, unto Gerald F Bennett.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
For Mortgagor’s Title see deed dated October 10, 1978 and recorded in the Bristol County (Fall River District) Registry of Deeds in Book 1244, Page 223.
TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within thirty (30) days after the date of sale.
