NOTICE OF PUBLIC HEARING FOR
CONSIDERATION OF A DEVELOPMENT AGREEMENT AMENDMENT
CITY OF PALM BAY, FLORIDA
Notice is hereby given that a public hearing will be held by the City Council on January 8, 2026, first reading, and on January 22, 2026, final reading, both to be held at 6:00 p.m. in the City Hall Council Chambers, 120 Malabar Road SE, Palm Bay, Florida, for the purpose of considering of the following matter of DAA25-00001.
Modification of a Development Agreement between the City of Palm Bay and Diaz Treasures, LLC, a Florida limited liability company, pertaining to property generally located southwest of the corner of Malabar Road SW and St. Johns Heritage Parkway NW, Brevard County, Florida (Tax Parcel 29-36-05-00-2) consisting of approximately 6.64 acres, a maximum 2.5 floor area ratio, and a maximum 70-foot building height, to be developed commercially for a gas station with accessory uses; convenience store; restaurant; and coffee shop. The proposed agreement modifies provisions and obligations pertaining to the construction of the St. Johns Heritage Parkway extension south of Malabar Road and establishes provisions for the inclusion of easement property that will allow site access onto Malabar Road.
A copy of the amended agreement may be inspected by the public between 8:30 a.m. and 5:00 p.m., weekdays, in the Office of the City Clerk, City Hall, 120 Malabar Road SE, Palm Bay, Florida.
If an individual decides to appeal any decision made by the City Council with respect to any matter considered at this meeting, a record of the proceedings will be required and the individual will need to ensure that a verbatim transcript of the proceedings is made, which record includes the testimony and evidence upon which the appeal is based (FS 286.0105). Such person must provide a method for recording the proceedings verbatim.
