NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by David B. O'Leary, Lisa M. O'Leary f/k/a Lisa M. Allen to Mortgage Electronic Re-gistration Systems, Inc., as nominee for Academy Bank N.A., dated November 10, 2022 and recorded in the Worcester County (Northern District) Registry of Deeds in Book 10467, Page 251, of which mortgage the undersigned is the present holder, by assignment from:
Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Academy Bank N.A., its suc-cessors and assigns to Pla-net Home Lending, LLC, re-corded on August 27, 2025, in Book No. 11051, at Page 201
for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 4:00 PM on January 30, 2026, on the mortgaged premises located at 29 Shady Avenue, Westminster, Worcester County, Massachusetts, all and sin-gular the premises de-scribed in said mortgage,
TO WIT:
The property located at 29 Shady Avenue, Westminster, Worcester North County, Commonwealth of Massachusetts, and being more particularly described as follows:
A certain parcel of land situated on the northeasterly side of Shady Avenue in Westminster, as further de-scribed and identified as Lot C on a Plan of Land entitled "Compiled Plan of Lots of Raymond J. Girouard Jr., et ux, Westminster, Mass., Scale: 1 inch = 100 Ft, January 4, 1974, Michael S. Szoc, R.I. Surveyor" and recorded in the Worcester County Registry of Deeds as Plan Book 185 Page 25 on January 25, 1974, and to which plan reference is hereby made for a more particular description. Said Lot C con-taining approximately 7.72 acres, more or less.
For mortgagor's(s') title see deed recorded with Worcester County (Northern Dis-trict) Registry of Deeds in Book 6125, Page 161.
These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all un-paid taxes, tax titles, tax liens, water and sewer liens and any other municipal as-sessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whe-ther or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE:
A deposit of Fifteen Thousand ($15,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The ba-lance is to be paid by certified or bank check at Har-mon Law Offices, P.C., 150 California St., Newton, Mas-sachusetts 02458, or by mail to P.O. Box 610389, Newton Highlands, Massachusetts 02461-0389, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. The description of the premises con-tained in said mortgage shall control in the event of an error in this publication.
