NOTICE OF SHERIFF'S SALE
By virtue of a certified copy of a decree to me directed from the Clerk of Circuit Court of Monroe County, Indiana, in Cause No. 53C06-2503-PL-000885 wherein Danny J. Truelock and Barbara Susan Truelock were Plaintiffs, and Benjamin Abel, Darian Brummett, Tiara Evans, Seth Evans, Jaden Evans, the heirs at law of Misty Abel, Jackson County Bank, Riverway Mechanical LLC and Hometowne Property Group a/m/a Summit Pointe United LLC were Defendants, requiring me to make the sum as provided for in said Decree with interest and cost, I will expose at public sale to the highest bidder, on February 20, 2026, at the hour of 10:00 a.m. or as soon thereafter as is possible, at www.zeusauction.com, the fee simple of the whole body of Real Estate in Monroe County, Indiana.
Lot Number One (1) in Truelock Minor Subdivision Final Plat, Amendment One, as shown by the plat thereof, recorded October 24, 2008, as Instrument Number 2008017588, in Plat Cabinet D, Envelope 87, in the Office of the Recorder of Monroe County, Indiana.
Also, the right to use a Fifty (50.00) foot wide easement for the purpose of ingress and egress and installation and maintenance of utilities, said easement being more particularly described as follows: Commencing at a set magnetic spike in Duncan Road marking the Southwest corner of the Northeast quarter of the Southeast quarter of Section Fourteen (14), Township Eight (8) North, Range Two (2) West, Monroe County, Indiana, thence along the West line of said Northeast quarter of the Southeast quarter North Zero (00) degrees Eighteen (18) minutes, Four (04) seconds East Four Hundred Ninety-six and Ninety-eight Hundredth (496.98) feet and to a set magnetic spike in Duncan Road marking the true point of beginning of this description; thence from said true point of beginning and leaving said West line and said Road North Eighty-nine (89) degrees, Fifty-nine (59) minutes, Sixteen (16) seconds East Six Hundred Forty-six and Twenty-eight Hundredths (646.28) feet; thence Two Hundred Twenty-three and Forty-six Hundredths (223.46) feet along a One Hundred Forty-two and Twenty-six Hundredths (142.26) foot radius tangent curve to the left whose cord bears North Forty-four (44) degrees, Fifty-nine minutes (59), Twenty-two (22) seconds East for a distance of Two Hundred One and Eighteen Hundredths (201.18) feet and to the South line of Lot #2 in Truelock Minor Subdivision; thence along said South line South Eighty-nine (89) degrees, Fifty-nine (59) minutes, Twenty-eight seconds West Fifty (50) feet; thence leaving said South line One Hundred Forty-four and Ninety-two Hundredths (144.92) feet along a Ninety-two and Twenty-six Hundredths (92.26) foot radius tangent curve to the right whose cord bears South Forty-four (44) degrees, Fifty-nine minutes, Twenty-two (22) seconds West for a distance of One Hundred Thirty and Forty-seven Hundredths (130.47) feet; thence South Eighty-nine (89) degrees, Fifty-nine (59) minutes, Sixteen (16) seconds West Six Hundred Forty-six (646.00) feet and to a set magnetic spike in said Duncan Road on said West line of the Northeast quarter of the Southeast quarter, passing a set 5/8 inch iron pin at One Hundred Twenty-eight and Fifty-six Hundredths (128.56) feet and Six Hundred Fifteen and Ninety-four Hundredths (615.94) feet; thence along said West line South Zero (00) degrees, Eighteen (18) minutes, Four (04) seconds West Fifty (50.00) feet and to the true point of beginning.
ALSO, TOGETHER WITH AND SUBJECT TO a non-obstructed, perpetual easement for ingress, egress, and utilities, as set forth in a Grant of Ingress, Egress, and Utilities Easement and Maintenance Agreement, recorded October 3, 2008, as Instrument Number 2008016575, and being more particularly described as follows: A part of the Northeast quarter of the Southeast quarter of Section Fourteen (14) , Township Eight (8) North, Range Two (2) West, Monroe County, Indiana, being more particularly described as follows : Commencing at a set magnetic spike in Duncan Road marking the Southwest corner of the Northeast quarter of the Southeast quarter of Section Fourteen (14) , Township Eight (8) North, Range Two (2) West, Monroe County, Indiana; thence along the West line of said Northeast quarter of the Southeast quarter North Zero (00) degrees, Eighteen (18) minutes, Four (04) seconds East Four Hundred Ninety-six and Ninety- eight Hundredths (496.98) feet and to a set magnetic spike in said Duncan Road marking the true point of beginning of this description; thence from said true point of beginning and leaving said West line North Eighty-nine (89) degrees, Fifty-nine (59) minutes, Sixteen (16) seconds East Six Hundred Forty-six and Twenty-eight Hundredths (646.28) feet; thence Sixty and Sixty-five Hundredths (60.65) feet along a One Hundred Forty-two and Twenty-six Hundredths (142.26) foot radius tangent curve to the left and to the South line of the lands now or formerly owned by Danny J. and Barbara Susan True lock as found in Deed Record 474, page 577, in the Office of the Recorder of Monroe County, Indiana; thence along said South line South Eighty-eight (88) degrees, Fifty-seven (57) minutes, Ten (10) seconds West Seven Hundred Five and Twenty-two Hundredths (705.22) feet and to the true point of beginning.

Together with rents, issues, income, and profits thereof, said sale will be made without relief from valuation or appraisement laws. If the sale is set aside for any reason, the purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Plaintiff or Plaintiff’s attorney.
Subject to all taxes, assessments, liens, encumbrances, rights of redemption, restrictions, and easements of record not otherwise extinguished in the proceedings known as Cause 53C06-2503-PL-000885 in the Circuit Court of the County of Monroe, Indiana.
