vs.
DONALD J. DY, et. al., Defendant(s).
UNDER AND BY VIRTUE OF EXECUTION AND ORDER OF SALE issued out of and under the seal of Superior Court of Maricopa County, State of Arizona, on the 6th day of November, 2025, and to me as Sheriff of said County duly directed and delivered in the above entitled action:
WHEREAS, on the 17th day of October, 2025, the above-named Plaintiff recovered a Judgment in the above-styled Court against the Defendant, as follows:
The principal sum of $6,633.58, together with interest thereon at the maximum per annum rate allowable by law at 8.25% per annum from the date of this Judgment until paid; For Plaintiff’s costs of Court in the amount of $1,016.99, and reasonable attorney’s fees in the amount of $2,902.50, according to of the CC&Rs, plus interest on all costs and fees at the maximum per annum rate allowable by law at 8.25% per annum from the date of judgment or accrual after judgment, until paid; That Plaintiff obtained a personal judgment against Defendant Donald J. Dy in the East Mesa Justice Court, Case No. CC2024012713RC (the “Personal Judgment”), and that attorneys’ fees in the amount of $1,655.00 and costs of court in the amount of $538.17 awarded therein are secured by the assessment lien pursuant to A.R.S. §33-1807 and may be collected through foreclosure of the assessment lien; That Plaintiff has an assessment lien against the Property in the amount of $7,601.75, and that such amount may be collected through a sheriff’s sale of the Property, including Monthly assessments, late fees, and collection charges that shall accrue from the date of this judgment until the time of sale, plus costs of Sheriff’s Sale, together with a foreclosure of Plaintiff’s lien against the Defendant, on the following described real property, to-wit:
Lot 56, of RePlat of a portion of Loma Villa, according to the Book 321 of Maps, Page 29, records of Maricopa County, Arizona; Except all oil, gas and other hydrocarbon substances, helium or other substances of a gaseous nature, geothermal resources, coal, metals, minerals, fossils, fertilizer of every name and description and except all materials which may be essential to production of fissionable material as reserved in Arizona.
AKA: 5901 E. Norwood St., Gilbert, Arizona.
NOW, THEREFORE, PUBLIC NOTICE IS HEREBY GIVEN that on the 29th day of January, 2026, at the hour of 10:00 A.M. at 301 West Jefferson Street, Room 250-8*, in the City of Phoenix, Maricopa County, State of Arizona, I will in obedience to said Execution and Order of Sale, sell all the right, title, claim and interest of the above named debtor, in, of and to the above described property at public auction to the highest bidder for cash or certified funds only, in lawful money of the United States, and apply the proceeds thereof to the payment and satisfaction of said judgment, together with the interest that may be due thereon and all costs of suit and accruing costs.
