By virtue of a Power of Sale contained in that certain Security Deed from KENDRA ELIZABETH HUNTER to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS INC. AS GRANTEE, AS NOMINEE FOR MOVEMENT MORTGAGE, LLC, dated July 28, 2017, recorded August 22, 2017, in Deed Book 1592, Page 695, Richmond County, Georgia Records, said Security Deed having been given to secure a Note of even date in the original principal amount of Seventy-Five Thousand Five Hundred Six and 00/100 dollars ($75,506.00), with interest thereon as provided for therein, said Security Deed having been last sold, assigned and transferred to Lakeview Loan Servicing, LLC, there will be sold at public outcry to the highest bidder for cash at the Richmond County Courthouse, within the legal hours of sale on the first Tuesday in March, 2026, all property described in said Security Deed including but not limited to the following described property:
ALL THAT LOT OR PARCEL OF LAND, WITH IMPROVEMENTS THEREON, SITUATE, LYING AND BEING IN THE 119TH DISTRICT, G.M. STATE OF GEORGIA, COUNTY OF RICHMOND, BEING SHOWN AND DESIGNATED AS LOT 5, BLOCK B, POLO COURT SUBDIVISION, ON A PLAT MADE BY CHARLES T. ALEXANDER, PROFESSIONAL LAND SURVEYOR, DATED FEBRUARY 18, 1964, RECORDED IN THE OFFICE OF THE CLERK OF SUPERIOR COURT OF RICHMOND COUNTY, GEORGIA, IN REALTY BOOK 32-V, PAGE 471. REFERENCE BEING MADE TO SAID PLAT FOR MORE COMPLETE AND ACCURATE DESCRIPTION OF THE METES, BOUNDS AND LOCATION OF SAID PROPERTY. THE ABOVE DESCRIBED PROPERTY IS CONVEYED SUBJECT TO A CERTAIN 25 FOOT STORM DRAINAGE EASEMENT EXTENDING ALONG THE NORTHERN BOUNDARY OF SAID PROPERTY GRANTED UNTO RICHMOND COUNTY, GEORGIA ON JULY 12TH, 1962, AND RECORDED IN THE SAID CLERK'S OFFICE IN REALTY BOOK 28-N, PAGE 680; A 20 FOOT SANITARY SEWER EASEMENT GRANTED UNTO THE CITY COUNCIL OF AUGUSTA ON SEPTEMBER 27, 1965, AND RECORDED IN SAID CLERK'S OFFICE IN REALTY BOOK 31-Z, PAGE 316; AND ALSO A 10 FOOT DRAINAGE AND UTILITY EASEMENT EXTENDING ALONG THE WESTERN BOUNDARY OF SAID PROPERTY, ALL AS IS MORE CLEARLY SHOWN ON SAID PLAT. THE ABOVE DESCRIBED PROPERTY IS CONVEYED SUBJECT TO A 10 FOOT WALKWAY OR PASSAGEWAY EASEMENT EXTENDING ALONG THE ENTIRE LENGTH OF THE NORTHERN BOUNDARY OF THE HEREIN ABOVE DESCRIBED PROPERTY, THE SAME TO BE USED AS A MEANS OF INGRESS AND EGRESS TO AND FROM A PUBLIC PARK LOCATED TO THE WEST OF THE NORTHWEST BOUNDARY OF THE HEREIN DESCRIBED PROPERTY, THE SAME TO BE USED BY THE RESIDENTS OF POLO COURT. SAID EASEMENT TO BE USED IN CONJUNCTION WITH A 10 FOOT EASEMENT EXTENDING ALONG THE NORTHWESTERN BOUNDARY OF LOT NO. 4 IN BLOCK B OF POLO COURT. SAID PASSAGEWAY SHALL NOT BE RESTRICTED BY ANY FENCES, BARRIERS OR OBSTRUCTION THAT WOULD PREVENT THE USE OF SAID EASEMENT FOR THE PURPOSES HEREIN INTENDED.
Said legal description being controlling, however the property is more commonly known as 2609 POLO CT, AUGUSTA, GA 30904.
The indebtedness secured by said Security Deed has been and is hereby declared due because of default under the terms of said Security Deed. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorneys’ fees (notice to collect same having been given) and all other payments provided for under the terms of the Security Deed.
Said property will be sold on an “as-is” basis without any representation, warranty or recourse against the above-named or the undersigned. The sale will also be subject to the following items which may affect the title: any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable); the right of redemption of any taxing authority; matters which would be disclosed by an accurate survey or by an inspection of the property; all zoning ordinances; assessments; liens; encumbrances; restrictions; covenants, and any other matters of record superior to said Security Deed.
To the best of the knowledge and belief of the undersigned, the owner and party in possession of the property is KENDRA ELIZABETH HUNTER, or tenants(s).
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed.
The entity having full authority to negotiate, amend and modify all terms of the loan (although not required by law to do so) is: LoanCare, LLC, Loss Mitigation Dept., 3637 Sentara Way, Virginia Beach, VA 23452, Telephone Number: 800-909-9525. Nothing in O.C.G.A. Section 44-14-162.2 shall be construed to require a secured creditor to negotiate, amend, or modify the terms of the mortgage instrument.
