NOTICE OF PUBLIC HEARING
Notice is hereby given that the Hamilton Township Zoning Hearing Board will hold a public hearing on Tuesday, February 3, 2026 at 4:30 PM at the Hamilton Township Municipal Building, 229 Fenner Avenue, Sciota, Pennsylvania 18354.
The hearing concerns an appeal filed by Kyle Possinger (Applicant), concerning a property consisting of approximately 27.29 acres owned by Nyles J. and Kitty I. Possinger and located at 726 Polk Valley Road, Hamilton Township, Monroe County, Pennsylvania, identified as Monroe County Tax Parcel No. 07.6.1.35-1. The property is located in the C-1 Zoning District.
The Applicant appeals a determination of the Hamilton Township Zoning Officer dated November 25, 2025, denying an application for a certificate of nonconforming use submitted by the property owner. The appeal is filed pursuant to Section 902.3 of the Hamilton Township Zoning Ordinance (Certificates of Non-Conforming Use and Structure) and Section 804.1 of the Zoning Ordinance (Appeals to the Zoning Hearing Board). The appeal relates to whether the Applicant has demonstrated the lawful existence of a nonconforming use on the property prior to the adoption of Ordinance No. 2008-02-11, which amended Section 402.1 (Use Class 5 – Industrial) of the Zoning Ordinance.
The Zoning Hearing Board will hear testimony and receive evidence from the Applicant and from other persons as permitted by law.
The application and supporting materials are available for public inspection at the Hamilton Township Municipal Building during regular business hours between 7:30 a.m. and 4:00 p.m. The hearing is open to the public.
