Default having been made in the payment of the indebtedness secured by that certain mortgage dated August 27, 2021, executed by TERENCE X. COLVIN, AN UNMARRIED MAN, to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. (“MERS”), AS NOMINEE, FOR
FIRST FEDERAL BANK, A FSB, ITS SUCCESSORS AND ASSIGNS, which mortgage was recorded on September 2, 2021, in Mortgage Book 2021, Page 92534, of the mortgage records in the Office of the Judge of Probate of Tuscaloosa County, Alabama and which mortgage was duly transferred and assigned to NEWREZ LLC D/B/A SHELLPOINT MORTGAGE SERVICING, notice is hereby given that pursuant to law and the power of sale contained in said mortgage, the undersigned will sell at public outcry, to the highest bidder for cash, in front of the Main entrance to the Tuscaloosa County Courthouse at Tuscaloosa, Alabama during the legal hours of sale on March 19, 2026, the following described real estate, situated in Tuscaloosa County, Alabama, to-wit:
A PART OF THE SOUTHWEST QUARTER OF THE NORTHWEST QUARTER, SECTION 7, TOWNSHIP 21 SOUTH, RANGE 8 WEST, TUSCALOOSA COUNTY, ALABAMA, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCE AT THE INTERSECTION OF THE EAST BOUNDARY LINE OF ELIZABETH STREET AND THE NORTH BOUNDARY LINE OF MARGARET AVENUE; THENCE RUN IN AN EASTERLY DIRECTION AND ALONG THE NORTH BOUNDARY LINE OF SAID MARGARET AVENUE FOR A DISTANCE OF 84.28 FEET TO THE POINT OF BEGINNING; THENCE CONTINUE IN AN EASTERLY DIRECTION AND ALONG THE NORTH BOUNDARY LINE OF SAID MARGARET AVENUE FOR A DISTANCE OF 83.51 FEET TO A POINT; THENCE WITH A DEFLECTION OF 74 DEGREES 45 MINUTES 30 SECONDS LEFT RUN IN A NORTHERLY DIRECTION FOR A DISTANCE OF 55.55 FEET TO A POINT, SAID POINT LYING ON THE SOUTH RIGHT OF WAY MARGIN OF OLD LOUISVILLE-NASHVILLE RAILROAD; THENCE WITH A DEFLECTION TO CHORD OF 88 DEGREES 51 MINUTES 30 SECONDS LEFT, RUN IN A WESTERLY DIRECTION AND ALONG THE CURVING SOUTH RIGHT OF WAY MARGIN OF SAID RAILROAD FOR A CHORD DISTANCE OF 97.23 FEET TO A POINT, SAID POINT LYING ON THE SOUTH RIGHT OF WAY MARGIN OF SAID RAILROAD; THENCE WITH A DEFLECTION TO CHORD OF 102 DEGREES 58 MINUTES 10 SECONDS LEFT, RUN IN A SOUTHERLY DIRECTION FOR A DISTANCE OF 81.18 FEET TO THE POINT OF BEGINNING, FORMING AN INTERIOR ANGLE OF CLOSURE OF 86 DEGREES 35 MINUTES 14 SECONDS.
This sale is made for the purpose of paying the indebtedness secured by said mortgage as well as expenses of foreclosure. This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the office of the Judge of Probate of the County where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to condition, title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
