NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by 60 Cross Street Investments, LLC to Stephane Marzabal, dated April 9, 2024, and recorded with the Middlesex Registry (Southern District) of Deeds in Book 82650 at Page 534, of which mortgage the undersigned is the present holder. For breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 12:00 P.M., on the 4th day of March, 2026, at 60 Cross Street, Units 109 & 231, Eastside Place Condominium, Somerville, MA 02145, all and singular the premises described in said mortgage,
To wit:
Unit No. 109 and Unit No. 231 (the “Unit”) of the Eastside Place Condominium (the “Condominium”) established pursuant to M.G.L. Chapter 183A by Master Deed dated April 27, 2022 and recorded with the Middlesex South Registry of Deeds on May 23, 2022 in Book 80162, Page 60 (the “Master Deed”), as may be amended of record, which Units are shown on the Floor Plans of the Building recorded simultaneously with the Master Deed, to which is affixed the verified statement of a registered architect in the form required by Section 8 of said Chapter 183A (the “Plans”).
The Units are conveyed together with:
1. Unit No. 109 having an undivided 1.27% interest in the common areas and facilities (“Common Areas”) of the Condominium described in the Master Deed, attributable to the Unit.
2. Unit No. 231having an undivided 1.74% interest in the common areas and facilities (“Common Areas”) of the Condominium described in the Master Deed, attributable to the Unit.
3. The exclusive right to use the Common Areas appurtenant or exclusive to the Units, including the walkways, stairways, both Units having the exclusive right to use garage parking spaces as set forth and described in the Master Deed, the condominium plans, and/or any amendments thereto.
4. An easement in common with the owners of other units to use any pipes, wires, ducts, flues, cables, public utility lines, and other Common Elements located in any of the other units or elsewhere in the Condominium and serving the Units.
5. Rights and easements in common with other Unit Owners as described in the Master Deed or shown on the Plans recorded with the Master Deed.
6. Said Units are conveyed subject to:
a. An easement in favor of the other units to use the pipes, wires, ducts, flues, cables, public utility lines, and other Common Elements located in any of the other units or elsewhere in the Condominium and serving the Units.
b. The provisions of the Unit Deed, the Master Deed, including without limitation the restrictions on use contained in Section 6 of the Master Deed, the Declarations of Trust of the Eastside Place Condominium dated April 27, 2022 (including any Rules, Regulations and Procedures that may be adopted therewith), which Declaration of Trust was recorded with said Deeds on May 23, 2022, in Book 80162, Page 75, as each of the same may be amended from time to time.
c. The provisions of M.G.L. c. 183A, as the same may, from time to time, be amended.
d. All easements, agreements, restrictions, and conditions of record, insofar as the same are now in force and applicable.
The Units are intended for residential purposes, and related uses allowed by the City of Somerville Zoning Ordinances, and no other use may be made of the Units.
Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
Terms of sale: A deposit of ten thousand dollars ($10,000) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by wire transfer to Demerle & Associates P.C., 10 City Square, 4th Floor, Boston, MA 02129 within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. In the event of an error in this publication, the description of the premises contained in said mortgage shall control.
