AN ORDINANCE OFFICIAL NOTICE Published by Authority of the Common Council of the City of Appleton Office of the City Clerk, Appleton Notice is hereby given that the following Ordinances were adopted by the Common Council on March 4, 2026 and approved by the Mayor on the 4th day of March 2026. 08-26 AN ORDINANCE AMENDING SECTION 19-86 OF CHAPTER 19 OF THE MUNICIPAL CODE OF THE CITY OF APPLETON, RELATING TO PARKING RESTRICTIONS. (Municipal Services Committee 02-18-2026) The Common Council of the City of Appleton does ordain as follows: Section 1: That Section 19-86 of Chapter 19 of the Municipal Code of the City of Appleton, relating to parking restrictions, is hereby created as follows. This ordinance supersedes and repeals any conflicting ordinance regarding parking in the designated area. Parking be prohibited on College Avenue from Lawe Street to Rankin Street. Section 2: This ordinance shall be in full force and effect from and after its passage and publication, and upon its passage and publication, the Traffic Engineer is authorized and directed to make the necessary changes in the Parking District Map in accordance with this Ordinance. 09-26 AN ORDINANCE AMENDING SECTION 19-86 OF CHAPTER 19 OF THE MUNICIPAL CODE OF THE CITY OF APPLETON, RELATING TO PARKING RESTRICTIONS. (Municipal Services Committee 02-18-2026) The Common Council of the City of Appleton does ordain as follows: Section 1: That Section 19-86 of Chapter 19 of the Municipal Code of the City of Appleton, relating to parking restrictions, is hereby repealed: Ord. 116-92: "Parking be restricted to two (2) hours from 7:00 a.m. to 5:00 p.m., Saturdays, Sundays and Holidays excepted, on the west side of McDonald Street from the north right-of-way line of Randall Avenue extending 190' north." Section 2: This ordinance shall be in full force and effect from and after its passage and publication, and upon its passage and publication, the Traffic Engineer is authorized and directed to make the necessary changes in the Parking District Map in accordance with this Ordinance. 10-26 AN ORDINANCE AMENDING CHAPTER 23 OF THE MUNICIPAL CODE OF THE CITY OF APPLETON, THE OFFICIAL ZONING MAP AND THE OFFICIAL SHORELAND ZONING DISTRICT MAP, WHICH IS A PART THEREOF, BY MAKING THE FOLLOWING CHANGES IN THE DISTRICT AS NOW PROVIDED. (City Plan Commission 03-04-2026) The Common Council of the City of Appleton does ordain as follows: Section 1: That Zoning Ordinance, Chapter 23 of the Municipal Code of the City of Appleton, the Official Zoning Map, and the Official Shoreland Zoning District Map, which is a part thereof, is amended by making the following changes: To rezone lands located at 5730 North Ballard Road (Tax Id #31-1-8311-00), including to the centerline of the adjacent street right-of-way, from AG Agricultural District to R-1B Single-family District, Shoreland-Wetland District, and Shoreland District. (Rezoning #1-26 – 5730 N. Ballard Road Annexation) LEGAL DESCRIPTION: A part of the Northwest 1/4 of the Southwest 1/4 of Section 6, Township 21 North, Range 18 East, City of Appleton, Outagamie County, Wisconsin, containing 84,219 square feet (1.93 acres) of land and more fully described as follows: Beginning at the West 1/4 corner of said Section 6; thence South 89 degrees 27 minutes 19 seconds East, 402.96 feet along the North line of the Southwest 1/4 of said Section 6 to the Northeast corner of Lands described in Document No. 2063812 and the boundary of Apple Ridge, a recorded subdivision in the City of Appleton; thence South 00 degrees 09 minutes 08 seconds East, 209.00 feet along the said boundary and the East line of said Lands to the Southeast corner thereof; thence North 89 degrees 27 minutes 19 seconds West, 402.96 feet along the South line of said Lands to the West line of the Southwest 1/4 of said Section 6; thence North 00 degrees 09 minutes 08 seconds West, 209.00 feet along said West line to the Point of Beginning. COMMON DESCRIPTION: 5730 North Ballard Road (Tax Id #31-1-8311-00), including to the centerline of the adjacent street right-of-way Section 2: This Ordinance shall be in full force and effect from and after its passage and publication, and upon its passage and publication the Director of Community Development and the Director of Public Works are authorized and directed to make the necessary changes to the Official Zoning Map and the Official Shoreland Zoning District Map in accordance with this Ordinance. 11-26 AN ORDINANCE AMENDING SECTION 19-90 OF CHAPTER 19 OF THE MUNICIPAL CODE OF THE CITY OF APPLETON, RELATING TO PARKING VIOLATION FORFEITURES. (Municipal Services Committee – 03-04-2026) The Common Council of the City of Appleton does ordain as follows: Section 1: That Section 19-90 of Chapter 19 of the Municipal Code of the City of Appleton, relating to parking violation forfeitures, is hereby amended to read as follows: Sec. 19-90. Parking violation forfeitures. (a) Any person to whom a citation has been issued for violation of any overtime parking regulation shall incur a forfeiture of forty-five dollars ($45.00), which forfeiture may be satisfied by paying twenty dollars ($20.00) within thirty (30) days of the date of the citation. (b) Any person to whom a citation has been issued for any prohibited parking during a special event, or for stopping, standing or parking around schools, shall incur a forfeiture of sixty-five dollars ($65.00), which forfeiture may be satisfied by paying forty dollars ($40.00) within thirty (30) days of the date of the citation. Any person to whom a citation has been issued for any other prohibited area parking regulation of the City shall incur a forfeiture of forty-five dollars ($45.00), which forfeiture may be satisfied by paying twenty dollars ($20.00) within thirty (30) days of the date of the citation. (c) Any person to whom a citation has been issued for violation of W.S.A. §346.505, pertaining to handicap parking, shall incur a forfeiture of three hundred dollars ($300.00), which forfeiture may be satisfied by paying three hundred dollars ($300.00) within thirty (30) days of the date of the citation. (d) Any person to whom a citation has been issued for violation of parking in an area designated no parking, for parking too close to a driveway or crosswalk, for parking on posted private property or any other parking restriction for which a forfeiture is not otherwise specifically established in this division, shall incur a forfeiture of forty-five dollars ($45.00), which forfeiture may be satisfied by paying twenty dollars ($20.00) dollars within thirty (30) days of the date of the citation. (e) Any person to whom a citation has been issued for violation of parking in an area from 2:00 a.m. to 5:00 a.m. shall incur a forfeiture of fifty dollars ($50.00), which forfeiture may be satisfied by paying twenty-five dollars ($25.00) within thirty (30) days of the date of the citation. (f) Any person to whom was issued their first and second citation in any calendar year for a violation of any meter parking regulation shall incur a forfeiture of thirty dollars ($30.00), which forfeiture may be satisfied by paying five dollars ($5.00) within thirty (30) days of the citation. (g) Any person to whom was issued their third through fifth citation in any calendar year for a violation of any meter parking regulation shall incur a forfeiture of thirty-five dollars ($35.00), which forfeiture may be satisfied by paying ten dollars ($10.00) within thirty (30) days of the citation. (h) Any person to whom was issued their sixth citation, or any citation thereafter, in any calendar year for a violation of any meter parking regulation shall incur a forfeiture of seventy-five dollars ($75.00), which forfeiture may be satisfied by paying fifty-five dollars ($55.00) within thirty (30) days of the citation. (i) Any person wanting to contest a parking citation shall, within thirty (30) days of the date of issuance, file an application for administrative review with the Director of Public Works and/or their designee in the manner prescribed on the citation. The administrative review shall constitute the City's final administrative determination. Any person aggrieved by the administrative determination may seek judicial review by filing a written request for judicial review with the City Parking Utility in the manner prescribed on the citation. The request for judicial review shall be submitted within forty-five (45) days from the date the citation was issued, or within fifteen (15) days after the administrative review is completed, whichever is later. When judicial review is requested, the City shall file the citation with the Clerk of Courts and mail notice of the date of the initial court appearance and updated total forfeiture amount (inclusive of court costs) to the aggrieved person. The citation shall be presumed to be uncontested if a request for administrative or judicial review is not filed timely. Forfeitures shall be paid within thirty (30) days of the citation's issuance or an action may be commenced by the City in accordance with the uniform traffic procedure for nonmoving violations as set forth in Sec. 345.28, Stats. and it may forward the matter to the State Department of Transportation for enforcement under the state traffic violation and registration program. Chapter 68 of the Wisconsin Statutes is inapplicable to the judicial review process set forth in this paragraph. (j) When a vehicle is the subject to seven (7) or more outstanding, unpaid parking citations issued in accordance with this section, the vehicle may be considered in chronic violation of the parking ordinances until such time that all outstanding parking citations are paid in full. Further, upon a subsequent violation, a vehicle considered in chronic violation of the parking ordinance pursuant to this section may be towed and impounded at the owner's expense. (k) Citations shall be paid in the following manner: (1) In person payment by cash or check and including either the physical citation, citation number or license plate number with the payment. (2) Online: using the citation number or license plate number, the citation can be paid with debit card or credit card. (l) Any third-party administration fees shall be added to, and collected with, parking violation forfeitures set forth in this section. A schedule of third-party administration fees charged pursuant to this section shall be on file in the office of the City Clerk. (Municipal Services Committee – 03-04-2026) The Common Council of the City of Appleton does ordain as follows: Section 1: That Section 19-91 of Chapter 19 of the Municipal Code of the City of Appleton, relating to parking on terraces, is hereby amended to read as follows: Sec. 19-91. Parking on terraces. (a) Penalty; parking on terraces. (1) First offense parking forfeiture. Any person to whom a citation has been issued for a violation of this section shall incur a forfeiture of forty-five dollars ($45.00), which may be satisfied by paying twenty dollars ($20.00) within thirty (30) days of the date of the citation. The procedures in Sec. 19-90(i), (k), and (l) apply to first offenses of this section. (2) Second and subsequent violations of this section. Any person who violates any provision of this section more than one time in a twelve (12) month period shall be subject to a penalty as provided in Sec. 1-16 of the Municipal Code.
