NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by DeWayne Burgess to Washington Mutual Bank, FA, dated December 15, 2003 and recorded in the Middlesex County (Southern District) Registry of Deeds in Book 41641, Page 372, as modified by a certain modification agreement recorded on July 15, 2019, and recorded with said Middlesex County (Southern District) Registry of Deeds in Book 72924, Page 548, of which mortgage the undersigned is the present holder, by assignment from:
Federal Deposit Insurance Corporation, as receiver of Washington Mutual Bank f/k/a Washington Mutual Bank, FA to JPMorgan Chase Bank, National Association, recorded on May 31, 2013, in Book No. 61915, at Page 402 for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 12:00 PM on March 25, 2026, on the mortgaged premises located at 94 Winter Street, Framingham, Middlesex County, Massachusetts, all and singular the premises described in said mortgage,
TO WIT:
The land located in Framingham, Middlesex County, Massachusetts shown as Lot 4 on a plan of land entitled "Plan of Land n Framingham, Mass.; Owner: David S. and Cheryl R. Hurwitz; Scale: 1" = 20'; Date: may 23, 1984; Schofield Bros. Inc. Professional Engineers and Registered Land Surveyors, 1071 Worcester Road, Framingham, MA 01701" and recorded in Middlesex Southern District Registry of Deeds as Plan No. 940 of 1984 in Book 15737 Page End on August 16, 1984.
The premises are conveyed together with the perpetual right and easement appurtenant to said Lot 4 to pass and repass over that portion of Lot 3 on a plan of land, entitled Plan of Land in Framingham, MA; prepared for American Developers of Massachusetts, Professional Engineers and Land Surveyors; 1701 Worcester Road, Framingham, MA and recorded in the Middlesex South Registry of Deeds as Plan No. 371, April 14, 1985, Instrument No. 202, which is labeled Access Easement, which easement has 25 feet of frontage on Salem End Road, and has a depth of 30.02 feet along the boundary by lots 3 and 4.

These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE:
A deposit of Fifteen Thousand ($15,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Harmon Law Offices, P.C., 150 California St., Newton, Massachusetts 02458, or by mail to P.O. Box 610389, Newton Highlands, Massachusetts 02461-0389, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. The description of the premises contained in said mortgage shall control in the event of an error in this publication.
