AMENDMENTS TO TOWN LAND DIVISION REGULATIONS
NOTICE IS HEREBY GIVEN that a public hearing will be held by the Plan Commission of the Town of Freedom, Outagamie Wisconsin, on 8th, April 2026, at 5:15 p.m. at the Freedom Town Hall, W2004 County Highway S, Freedom at which time the Commission will hear public comments on proposed text amendments to Chapter 18: Land Division Regulations (hereafter, Chapter 18) of the Town of Freedom Municipal Code. The purpose of these amendments is to bring Chapter 18 into compliance with 2025 Wisconsin Act 58.
Chapter 18: Land Division Regulations regulates and controls the division of land in order to promote the public health, safety, morals, prosperity, aesthetics, and the general welfare of the Town. Proposed changes are as follows:
Amend Section 18-072.D to reads as follows:
'Approval of a preliminary plat shall not constitute automatic approval of the final plat, except that if the final plat is submitted within 36 months of the preliminary plat approval and conforms substantially to the preliminary plat as approved, including any conditions of that approval, and to any local plans and ordinances adopted as authorized by law, as indicated in Wis. Stat. § 236.11(1)(b), the final plat is entitled to approval.'
Add the following as Section 18.072.E:
'Upon Town Board approval of the Preliminary Plat and within 10 days of the subdivider submitting the plat with all required certificates and affidavits the Town Clerk shall make a certification of approval on the face of the Preliminary Plat for the purposes of the subdivider filing the approval plat with the Outagamie County register of Deeds.'
Amend Section 18-090.G to read as follows:
'No building permits may be issued by the Town until all improvements specified in the development agreement have been agreed to.'
Amend Section 18-091 to read as follows:
'After the Final Plat has been approved by the Town Board and a contract and sureties ensuring their installation is filed, the Town Clerk shall cause the certificate inscribed upon the Plat attesting to such approval to be duly executed and the Plat to be forwarded to the County Register of Deeds for recording. The Register of Deeds shall not record the plat unless it is offered within 12 months after the last approval and within 36 months after the date of the first approval.'
Chapter 18 is available for public inspection at the Town Hall and on the Town of Freedom website located at http://www.townoffreedom.org/. Written testimony may be submitted to: Town of Freedom Plan Commission, Attn: Town Clerk, PO Box 1007, Freedom, WI 54131, or emailed to the Town Clerk at treasurer@tn.freedom.wi.gov by noon on the day of the Public Hearing.
All interested persons will be given an opportunity to be heard. Testimony may be provided in writing or in person.
