MORTGAGEE’S NOTICE OF SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Phillip M. Stan to SALEM FIVE MORTGAGE COMPANY, LLC, dated April 21, 2010 and recorded with the Worcester County (Worcester District) Registry of Deeds at Book 45699, Page 99, subsequently assigned to JPMORGAN CHASE BANK, N.A. by SALEM FIVE MORTGAGE COMPANY, LLC by assignment recorded in said Worcester County (Worcester District) Registry of Deeds at Book 45699, Page 112, subsequently assigned to LAKEVIEW LOAN SERVICING, LLC, ITS SUCCESSORS AND ASSIGNS by JPMORGAN CHASE BANK, N.A. by assignment recorded in said Worcester County (Worcester District) Registry of Deeds at Book 60649, Page 116 for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction at 11:00 AM on April 2, 2026 at 47 Foss Road, Gardner, MA, all and singular the premises described in said Mortgage, to wit:
A certain tract of land situated on the westerly side of Foss Road, in said Gardner, and being lots numbered 203 and 204 as shown on plan of Fairview drawn by J. S. Crossman, C. E., dated May, 1911 and recorded with Worcester District Deeds, being more particularly bounded and described as follows:
Being at a stake on the northeasterly corner thereof and on the westerly line of said Foss Road and being 25 feet northerly 1917 layout;
Thence westerly by land now or formerly of David Woutllainen 100 feet to a stake;
Thence southerly at an included angle of 90° by land of Sofia Berg, 50 feet of an iron pin;
Thence easterly at an included angle of 90° by land now or formerly of Clifford J. Bourgeois, 100 feet to an iron pin in the westerly line of said Foss Road;
Thence northerly at an included angles of 90° along said westerly line of Foss Road, 50 feet to the place of beginning.
The first mentioned line and the last mentioned line forming and included angle of 90°.

For consideration paid, the signors of the mortgage to which this Exhibit is attached , (the Mortgage) hereby release any and all rights of homestead in and to the mortgaged premises as against the holder of the Mortgage. It is agreed that any such Homestead shall not have any
effect upon the Mortgage and to the extent such Homestead is legally enforceable, shall be subordinated and junior to said Mortgage in every respect.
The premises are to be sold subject to and with the benefit of all easements, restrictions, encroachments, building and zoning laws, liens, unpaid taxes, tax titles, water bills, municipal liens and assessments, rights of tenants and parties in possession, and attorney’s fees and costs.
TERMS OF SALE:
A deposit of FIVE THOUSAND DOLLARS AND 00 CENTS ($5,000.00) in the form of a certified check, bank treasurer’s check or money order will be required to be delivered at or before the time the bid is offered. The successful bidder will be required to execute a Foreclosure Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified check, bank treasurer’s check or other check satisfactory to Mortgagee’s attorney. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication. TIME WILL BE OF THE ESSENCE.
FinCEN reporting will be required of all successful purchasers, absent a lawful exemption.
