ORDINANCE NO. 882
AN ORDINANCE TO AMEND CHAPTER 440, PARKING
OF THE CODIFIED ORDINANCES OF THE CITY OF COLDWATER
WHEREAS, the City of Coldwater (the “City”) has authority pursuant to Public Act 279 of 1909, the Home Rule City Act, to provide for the parking of vehicles within its corporate limits; and
WHEREAS, the Charter of the City provides at Section 2.2 that the City has the power to regulate parking in the City upon City streets and property for the public welfare; and
WHEREAS, Chapter 440 of the Codified Ordinances of the City provides for certain limitations and prohibitions on the parking of vehicles on City property; and
WHEREAS, the City’s Zoning Code restricts off-street parking; and
WHEREAS, the City Council desires to amend its ordinances, Chapter 440, to more clearly clarify the prohibition of front yard parking as specified in the Zoning Ordinance;
NOW THEREFORE, THE CITY OF COLDWATER HEREBY ORDAINS:
Section 1. Section 440.01(b), Front Yard Parking, shall be added to read as follows:
(b) Front Yard Parking. Parking or storage of motor vehicles, trailers, watercraft or recreational vehicles in a front yard within a residential district is prohibited. For purposes of this ordinance the definitions of front yard and residential districts shall be those used in the Zoning Code. However, this section shall not apply to the items described if:
(1) Lawfully parked in a driveway, which shall be paved or surface approved by the Zoning Administrator;
(2) Actively engaged in loading or unloading; or
(3) Otherwise authorized by another ordinance.
Section 2. Effective Date. This Ordinance shall be effective 21 days after adoption and after publication as prescribed by law.
Section 3. All ordinances, resolutions, or rules inconsistent with these provisions are hereby repealed. Should any section, clause, or phrase of this ordinance be declared invalid, the same shall not affect the validity of the ordinance as a whole or any other part.
The foregoing ordinance was duly adopted at a regular meeting of the Council of the City of Coldwater at which a quorum was present on March 9, 2026.
