ORDINANCE NO. 883
AN ORDINANCE TO AMEND CHAPTER 1610, FIRE CODE OF THE NATIONAL FIRE PROTECTION ASSOCIATION OF THE CODIFIED ORDINANCES OF THE CITY OF COLDWATER
WHEREAS, the City Council is vested with the policy-making powers of the City of Coldwater as provided in Section 4.1 of the City Charter and the legislative powers for the City as provided in Section 5.1 of the City Charter; and
WHEREAS, the Fire Prevention Code, specifically MCL 29.2b, authorizes cities to designate a local Fire Marshal to be employed as a full-time fire inspector through an organized fire department and certified by the Bureau of Fire Services; and
WHEREAS, the City of Coldwater has designated an employee as the local Fire Marshal and fire inspector; and
WHEREAS, the City has adopted the National Fire Prevention Code 1 (NFPA), which includes some regulation of mobile and temporary cooking and authorizes the adoption of local permit requirements; and
WHEREAS, the proliferation of food trucks operating within the City of Coldwater warrants adoption of portions of NFPA 96 and 58 to set a clear fire safety standard for mobile food establishments; and
WHEREAS, the City Council desires to amend its ordinances, Chapter 1610, to add Chapter 17 of NFPA 96 and Chapter 16 of NFPA 58.
NOW THEREFORE, THE CITY OF COLDWATER HEREBY ORDAINS:
Section 1. Section 1610.13, Mobile Food Establishment Regulation, shall be added as follows:
Pursuant to the authority granted in the Home Rule Cities Act, specifically MCL 117.3(k), the City of Coldwater hereby adopts Chapter 17 of NFPA 96, Standard for Ventilation Control and Fire Protection of Commercial Cooking Operations, and Chapter 16 of NFPA 58, Liquefied Petroleum Gas Code. The Fire Marshal is authorized to make and enforce the provisions of these codes as it relates to mobile food establishments and any other applicable circumstance. A copy of these codes shall be on file with the City Clerk and available for public inspection and distribution at City Hall, 1 Grand Street, Coldwater, Michigan.
Section 2. Effective Date. This Ordinance shall be effective 21 days after adoption and after publication as prescribed by law.
Section 3. All ordinances, resolutions, or rules inconsistent with these provisions are hereby repealed. Should any section, clause, or phrase of this ordinance be declared invalid, the same shall not affect the validity of the ordinance as a whole or any other part.
The foregoing ordinance was duly adopted at a regular meeting of the Council of the City of Coldwater at which a quorum was present on March 9, 2026.
