In accordance with the Judgment and Decree of Foreclosure by Judicial Sale filed on August 27, 2025, in the above captioned action brought to foreclose that certain mortgage given by Jay A. Bennett and Kathleen M. Bennett to Beneficial Mortgage Co. of New Hampshire, dated September 26, 2006, and recorded in Book 358, at Page 190, of the Town of Milton Land Records, of which mortgage the undersigned is the present holder by virtue of the following Assignments of Mortgage: (1) Assignment of Mortgage from Beneficial New Hampshire Inc., successor by merger to Beneficial Mortgage Co. of New Hampshire to U.S. Bank Trust, N.A., as Trustee for LSF9 Master Participation Trust recorded in Book 466, at Page 121 (2) Assignment of Mortgage from U.S. Bank Trust, N.A., as Trustee for LSF9 Master Participation Trust to Goldman Sachs Mortgage Company recorded in Book 491, at Page 716 (3) Assignment of Mortgage from Goldman Sachs Mortgage Company to UMB Bank, National Association, not in its individual capacity, but solely as Legal Title Trustee of LMAT Legal Title Trust 2014-RPL1 recorded in Book 491, at Page 717 (4) Gap Assignment of Mortgage from UMB Bank, National Association, not in its individual capacity, but solely as Legal Title Trustee of LMAT Legal Title Trust 2014-RPL1 to Goldman Sachs Mortgage Company recorded in Book 555, at Page 250 (5) Assignment of Mortgage from Goldman Sachs Mortgage Company to Wilmington Trust, National Association, not in its individual capacity, but solely as Owner Trustee of Bravo Residential Funding Trust 2021-A, as Owner of PMIT REI 2021-A LLC recorded in Book 546, at Page 280 (6) Assignment of Mortgage from Wilmington Trust, National Association, not in its individual capacity, but solely as Owner Trustee of Bravo Residential Funding Trust 2021-A, as Owner PMIT REI 2021-A LLC to UMB Bank, National Association, not in its individual capacity, but solely as Legal Title Trustee of LVS Title Trust XIII recorded in Book 546, at Page 709 and (7) Assignment of Mortgage from UMB Bank, National Association, not in its individual capacity, but solely as Legal Title Trustee for LVS Title Trust XIII to U.S. Bank Trust National Association, not in its individual capacity, but solely as Owner Trustee for RCF 2 Acquisition Trust recorded in Book 555, at Page 701, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on April 15, 2026 at 03:00 PM at 151 Cooper Road, Milton, VT 05468 all and singular the premises described in said mortgage,
To Wit:
Being all and the same lands and premises conveyed to Jay Bennett by Quitclaim Deed of Kathleen Bennett dated September 2, 2014 and recorded February 17, 2017 in Book 474, at Page 755 of the Town of Milton Land Records and further described therein.
BEING A PARCEL OF LAND WITH BUILDINGS THEREON, SITUATED IN THE TOWN OF MILTON. SAID PARCEL BEGINNING AT A BARBED WIRE FENCE AND RUNNING EAST A DISTANCE OF 200 FEET ALONG TOWN HIGHWAY NO. 16; THENCE TURNING AND RUNNING NORTH A DISTANCE OF 200 FEET; THENCE TURNING AND RUNNING WEST A DISTANCE OF 200 FEET; THENCE TURNING AND RUNNING SOUTH A DISTANCE OF 200 FEET TO THE POINT AND PLACE OF BEGINNING.
BEING LOT #1 AS DEPICTED ON A 1974 SURVEY RECORDED AT MAP BOOK #2, PAGE 43 OF SAID LAND RECORDS.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
The public sale may be adjourned one or more times for a total time not exceeding 30 days, without further court order, and without publication or service of a new notice of sale, by announcement of the new sale date to those present at each adjournment or by posting notice of the adjournment in a conspicuous place at the location of the sale.
Terms of Sale: $10,000.00 to be paid in cash or by certified check by the purchaser at the time of sale, with the balance due at closing. The sale is subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens, if any, which take precedence over the said mortgage above described.
The Mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
