NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Daniel T. Bruley to Mortgage Electronic Registration Systems, Inc., as nominee for Countrywide Bank, FSB, dated October 30, 2007 and recorded in the Worcester County (Worcester District) Registry of Deeds in Book 42006, Page 274, as modified by a certain modification agreement recorded on June 25, 2019, and recorded with said Worcester County (Worcester District) Registry of Deeds in Book 60601, Page 112, of which mortgage the undersigned is the present holder, by assignment from:
Mortgage Electronic Registration Systems, Inc., as nominee for Countrywide Bank, FSB to M&T Bank, recorded on July 30, 2012, in Book No. 49354, at Page 298
M&T Bank to Selene Finance LP, recorded on October 3, 2024, in Book No. 71110, at Page 148
for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 12:00 PM on April 14, 2026, on the mortgaged premises located at 9 Birches Road, Hubbardston, Worcester County, Massachusetts, all and singular the premises described in said mortgage,
TO WIT:
A certain parcel of land located on the westerly side of Birches Road, Hubbardston, Worcester County, Massachusetts with the buildings thereon, and bounded and described as follows:
BEGINNING at a point in the westerly line of said Birches Road at the northeasterly corner of Lot "H" as shown on a plan hereinafter referred to, said point being northerly a distance of 260 feet along said Road from land now or formerly of Norman A. and Jeanne M. Hebert;
THENCE North 54 degrees 23' 11" West, a distance of 451.64 feet by said lot "H" to a point at land now or formerly of said Hebert et ux;
THENCE North 37 degrees 20' 56" East, a distance of 200.00 feet, by said Hebert land to a point at the southwesterly comer of lot "F" as shown on said hereinafter referred to plan;
THENCE South 54 degrees 18' 51" East, a distance of 441.41 feet, by said Lot "F" to a point in the westerly line of said Birches Road;
THENCE South 47 degrees 53' 41" West, a distance of 10.65 feet to a point;
THENCE South 37 degrees 10' 20" West, a distance of 86.19 feet to a point;
THENCE South 30 degrees 43' 45" West, a distance of 103.16 feet to the point of beginning, the last three courses being by the westerly line of said Birches Road.
Containing 88,393 square feet (2.029 acres).
Being shown as Lot "G" on a plan entitled "Plan of Lots Prepared for Dymek Custom Builders, Inc. Hubbardston, MA April 8, 1996, Szoc Surveyors, 32 Pleasant Street, Gardner, MA" recorded in the Worcester District Registry of Deeds in Plan Book 703, Plan 109.
For mortgagor's(s') title see deed recorded with Worcester County (Worcester District) Registry of Deeds in Book 42006, Page 272.
These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE:
A deposit of Ten Thousand ($10,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Harmon Law Offices, P.C., 150 California St., Newton, Massachusetts 02458, or by mail to P.O. Box 610389, Newton Highlands, Massachusetts 02461-0389, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. The description of the premises contained in said mortgage shall control in the event of an error in this publication.
