The Awarding Authority reserves the right to reject any pre-qualification submission which is not responsive or where the acceptance of such submission would not be in the best interest of the Awarding Authority. The responsiveness of the submission will be determined by the completeness and accuracy of the submission. An incomplete submission will delay and possibly eliminate consideration of that applicant's submission. The pre-qualification of contractors does not imply that any bid submitted by a pre-qualified contractor automatically qualifies that bid as a "competitive," "responsible," or "satisfactory" bid. Prospective bidders will be notified of the results of pre-qualification and bid packages will be made available to approved bidders no later than 4:00 p.m., Friday, 24th day of April 2026. Pre-Bid Conference A mandatory pre-bid conference for the Project will be held on Tuesday, 28th day of April 2026 at 2:00 p.m. at Black Warrior Solid Waste Authority at 3301 Landfill Drive, Coker, Alabama 35452. Bids will not be accepted from Bidders that do not attend the mandatory pre-bid conference. Bidders will be required to provide Bid security in the form of a Bid Bond or cashier's check in the amount of a sum no less than five (5) percent of the Bid Price but not more than $10,000.00. All bids must be submitted in a sealed envelope bearing on the outside the name of the bidder, bidder's license number, address and name of the project. Your Bid will be required to be submitted under a condition of irrevocability for a period of sixty (60) days after submission. The attention of bidders is called to the provisions of State Law Governing General Contractors, as set forth in Title 34, Chapter 8, Article 1, Code of Alabama of 1975, as amended; and the provisions of said law shall govern bidders insofar as applicable. The above-mentioned provisions of the Code make it illegal for the Owner to consider a bid from anyone who is not properly licensed under such code provisions. In addition, bidders must carry the Specialty Construction-Environmental classification as listed in the latest edition of the Roster of the State Licensing Board for General Contractors, Montgomery, Alabama. The Owner, therefore, will not consider any bid unless the bidder produces evidence that he is so licensed. Neither will the Owner enter a Contract with a foreign corporation which is not qualified under State Law to do business in the State of Alabama. The attention of nonresident bidders is called to the provisions of Alabama Law, Title 39, Chapter 3, Code of Alabama 1975, as amended, relating to preference to be given to resident contractors in Alabama over nonresident contractors in the award of contracts in the same manner and to the same extent as provided by the laws of the state of domicile of the nonresident contactor, and to the requirements that the bid documents tendered by any nonresident contractor must be accompanied by "a written opinion of an attorney-at-law licensed to practice law in such nonresident contractor's state of domicile as to the preference, in any or none, granted by the law of that state to its own business entities whose principal places of business are in that state in the letting of any or all public contracts". Each Bidder, and each Subcontractor, is required to complete and submit Document 00450 – Affidavit of Immigration Compliance along with their E-Verify Program Memorandum of Understanding at the time of the Bid. No Contract will be awarded to any Bidder who does not submit the required Immigration Compliance documents. Contractors will be required to provide two (2) Owner's Protective Liability Policies.
