ORDINANCE NO. 3148
AN ORDINANCE TO REZONE ALL, OR PORTIONS OF, THE PROPERTIES LOCATED AT 2119, 2263, 2301, AND 2321 W. PUETZ RD., AND 8830 S. 27TH ST., FROM RS-2 SINGLE-FAMILY RESIDENTIAL TO RD-1 TWO-FAMILY RESIDENTIAL DISTRICT.

WHEREAS, Anthony Rodriguez, Heyday, has applied to rezone all, or portions of, the properties located 2119, 2263, 2301, and 2321 W. Puetz Rd., and 8830 S. 27th St., from Rs-2 Single-family Residential to Rd-1 Two-family Residential District; and,
WHEREAS, the Plan Commission reviewed said application at its January 27, 2026 meeting and recommended that the rezoning of the properties located 2119, 2263, 2301, and 2321 W. Puetz Rd., and 8830 S. 27th St. to Rd-1 Two-family Residential District be approved; and,
WHEREAS, the Common Council held a public hearing on said application on March 17, 2026, at which time all interested parties appeared and were heard; and,
WHEREAS, following said public hearing, with the favorable recommendation of the Plan Commission, and having determined that the proposed rezoning is consistent with the Comprehensive Land Use Plan of the City of Oak Creek, the Common Council is of the opinion that the best interests of the City of Oak Creek would be served if the Rd-1 Two-family Residential District rezoning of all, or portions of, the properties located at 2119, 2263, 2301, and 2321 W. Puetz Rd., and 8830 S. 27th St. was approved, for the lands described below.
NOW, THEREFORE, BE IT RESOLVED, the Common Council of the City of Oak Creek does hereby ordain as follows:
SECTION I. To promote the general welfare, public safety and general planning within the City of Oak Creek, the properties located at 2119, 2263, 2301, and 2321 W. Puetz Rd., and 8830 S. 27th St., legally described below, are hereby rezoned from Rs-2 Single-family Residential to Rd-1 Two-family Residential District, and the Zoning Map of Chapter 17 of the Municipal Code is amended to reflect the rezoning:

SECTION II. The terms and provisions of this ordinance are severable. Should any term or provision of this ordinance be found to be invalid by a court of competent jurisdiction, the remaining terms and provisions shall remain in full force and effect.
SECTION III. All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed.
SECTION IV. This ordinance shall take effect and be in force from and after its passage and publication.
